Help! Accidental damage - Engagment ring [no receipt]

I bought an engagement ring from Warren James on New Years Eve 2012 to propose that night at midnight. I bought a 2 year guarantee with the ring but my fiance took the ring in to have it made smaller or for a smaller sized ring.

Everything was fine but we went away on holiday and whilst on an excursion she took the ring off and placed it in her pocket so the ring suffered no damage etc as we were on a jeep safari and we were unaware until we arrived that there was a huge water fight.

Long story short we stopped for several breaks and the ring ended up being damaged after it fell out of her pocket! One of there jeeps ran over it. So it wasn't until now that my fiance realised that she no longer had the receipt or the warranty as it was stapled to the receipt. She said that she doesn't think she brought the receipt back out of the shop when she took it to be re-sized which was around mid January time. :cry:

So my question is am I able to take the ring back without the receipt or guarantee slip? Would I be able to show them proof of purchase with a bank statement proving when it was bought etc?

Any help really would be hugely appreciated,

    I think the warranty probably wouldn't cover it for accidental damage, but you could ask.
    Yes, a bank statement would be enough for proof of purchase.

    Could you/she claim on household contents insurance.

  • No, sorry without me physically having the warranty slip I meant. Would they still have to repair or exchange it when I don't have the receipt or slip?

    A warranty is in addition to your statutory rights and because of this the warranty issuer can impose reasonable conditions.

    If the warranty states that to get service under the warranty you must provide the shop receipt and the warranty documentation, then that is what you must do.

    Of course you don't know what conditions there are as you don't have the documentation.

    As far as I can see your only option is to ask the seller if they can help you.
    As said above, a bank or credit card statement may help, but you really are at the mercy of whoever you think is providing the warranty.

    Although you say accidental damage is covered, what are you going to do if they say "accidental damage is not covered".
    Losing the warranty documentation is bad news.
  • I totally agree with you, losing the documentation really is bad news. I will just have to take it in and hope for the best.

    When going into the shop, maybe start off by asking about if they have a copy of the warranty terms from December when you bought a ring off them, you've mislaid yours. I'm sure someone can find an old warranty form, or it may be the same policy they still offer. All if you can take a photocopy. Then you will know for absolute certain what terms you're going to claim under (and your confidence that they'll entertain it). beating in mind one of the warranty conditions might or might not be that you keep the original receipt etc., so clarity will be important before a claim.

    FWIW I'd expect Jeep damage to be a bit of bending as opposed to a write-off, it may be an easyish fix for a manufacturing jeweller if there turns out to be warranty issues.

    Have you checked to see if your holiday insurance would cover it?

    When you bought the extended warranty/accidental damage cover, did you supply your name and address? If so then there should be a record of it, however if the terms require that you have the original proof of purchase then you don't really have any grounds to stand on.
