    Why do you feel the business should be regarded as seperate to any other marital asset ? It is usual that all assets are considered jointly-are there special circumstances that make the business different to any other asset within the marriage ?

    He is actually asking how much spousal maintenance he may have to pay to his wife, not his child. His child is his responsibility, he is accepting this and providing for his child financially, his wife is not his responsibility and she is more than able as an adult to provide for herself financially instead of relying on someone elses wage.


    Reading the posts, it appears that in Scotland, his wife is legally his responsibility and he's seeking to cook the books to avoid this legal obligation.

    My understanding of the situation in Scotland would be that if you didn't support your ex, and in fact she earned more than you, you wouldn't be required to pay anything for her.

    I'm not an expert so may have got this wrong, but feeling guilty after my earlier post I looked it up.

  • I would also like to point out that my ex has just turned down a £70K per annum job.
    We are not talking about a destitute abandoned wife and child here. Both are living very well and have no financial issues whatsoever.
    A company director can draw a salary taking all or some of the businesses revenue.
    Im new to being a Director but would really like to make the business work. My question is in order for me to gauge if its actually worth me trying to build a business at this time in my life.

    Unless the law is very different in Scotland, it still isn't his responsibility to support his ex.
