Late Flight Montegro Airlines - does this qualify for compensation?

A few days ago our Montenegro Airlines flight form Tivat to Gatwick departed 3hrs 15 mins late due to a "minor technical problem". Montenegro is in the Eurozone but not(?) in EU.
Are we able to claim compensation for the delay?

It has to be an EU based airline when the departure point is outside the EU so you fail on both counts. The good news is that Montenegro has applied for membership so if it happens in a few years time, you may be covered, although the time limit goes up to 5 hours from three under current proposals......0
