Leave out all the scattergun references to prior court cases, they've not proved to be directly relevant to adjudications. By that I mean I've not seen any adjudicator say 'Yes, the Dunlop v New Garage case has overtly influenced my decision, which would have been to the contrary had it not been referenced in this appeal in the context of GPEOL'.
There are far too many appeals with a long line of case references, where I doubt the appellant has even read them, let alone understood them. No need, and, IMHO, no real help. Save your ink.
Get the adjudicator as quickly as possible to GPEOL, and receive your appeal upheld decision.
And, to be quite honest, from a personal point of view, when I see a long, drawn out, throw the kitchen sink at it draft appeal (even though the OP seems to have little idea about what they are putting in there) containing so much (irrelevant) verbiage, I'm far less inclined to plough through it all to give my opinion.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

True, but the Assessor Marina Kapour seized upon that exact case in the 'longest Assessor's decision ever' in the Town Quay case (ParkingEye) already linked a few posts back (but not quoted in full on MSE as it was so long):

She literally tore into PE's 'commercially justified' argument, in such a brilliant way that I have since quoted her in another POPLA appeal and intend to do so again! Her decision in the Town Quay case read as though she was giving people pointers to a court defence.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
