Malaga to Manchester Delays Jet 2

I have recently forwarded two flight delays from Malaga airport to Manchester. Both were with Jet 2
LS810 12/09/2009 - delayed by 4 hours 40minutes
LS810 19/10/2008 - delayed by 9 hours 45 minutes.
Jet 2 have responded to both claims, by stating all claims must be made within 2 years of the actual flight. My understanding from this forum is that claims can in some instances go back as far as 2005, so I cannot understand the reply from Jet 2. Please advise if anyone else has encountered this type of reply.
