Indeed it's not but by the same token, a lot of claims are settled prematurely through ignorance of the claims handler.
Red traffic lights, two vehicles collide with no witnesses - that would be a good example of what you are saying.
Let's say it's a roundabout that isn't wide enough for the LGV to negotiate at the same time as the OP's Son. Now what ratio do you use in deciding whether the LGV is negligent because part of his vehicle is encroaching on another lane and collides with another vehicle alongside, or the car alongside should have anticipated the trailer? Are they both negligent?
Tell me, what training do claims handlers get on the issue of negligence and road traffic law?0 -

Your initial arguement was about the injustice of the OP's situation which it should be noted was on a three lane roundabout.
In your new arguement based on the OP's situation eg front corner damage and (I assume) rear third damage to the truck it would tend to be 50/50 without a witness as most roundabout claims are settled.
You need to bear in mind that in a very large percentage of accidents each party will give a different description of the incident slanted towards them not being the guilty party. Without other good evidence such as areas of impact on each vehicle and / or witnesses it makes it difficult to make a totally fair decision0 -

Two or three lanes makes no difference. Areas of impacts should be available quite readily. Witnesses are the poorest form of evidence (but acceptable).0 -
I phoned Admiral this pm as someone from their Claims Dept. had left a text on sons phone today; he could not respond due to work 'stuff'. He got no where when he tried later: no one available, gone home after 5pm. He had to rush off again to work, won't see him till tomorrow night again. I decided to phone and try to get to the bottom of who had called and why? Found out pretty quick that it was 'Quality Control' (Complaints) who had texted him today, they are part of Claims dept. Message had said to call about his 'CLAIM' not about his 'COMPLAINT'!! When he had phoned back, he'd been fobbed off with maybe someone getting back to him sometime in SEPTEMBER as he is away on holiday next week and in Worcester for 2 weeks after that!! Hence my call to Admiral! Anyway after finding out that the call was from Complaints dept. and NOT about his 'claim - collision' I enquired about the 'progress'; had they been in touch with 3rd party yet??
Well they have and been told by 3rd party that there is no damage to truck and no claim will be made. CASE CLOSED!!!
Now I ask you, apart from my euphoria (and son's) that this is now over, WHY DID NO ONE CALL AND TELL HIM (me) THAT????
I am defo. pursuing a complaint with them as they are something else, are they not?? BUT THANKS TO ALL OF YOU FOR SUPPORT ESPECIALLY forgotmyname as you really made me think about driving, from a truckers point of view, and I will defo. be giving all truckers a WIDE BERTH in future, as you so rightly deserve and need being 'Kings of the road' and all lol.... I have made sure 'son' is also going to give you guys all the space you need in future. No more 'kissing' with trucks; causes way too much hassle all round. Now I'm off to have a 'stiff' one; I deserve it!!0
