From what you've said about the accident I'd have dealt direct with the Next distributor direct rather than going through my insurance company.
However now it's been done and your son has had second thoughts .... Can you phone the Next Distributor and ask them to confirm to Admiral that they will settle the claim direct with your son and confirm they won't be making a counter claim?
If they agree to do that and tell Admiral so, then surely Admiral can drop their crusade and just note on your son's record that an incident took place but no claim was made.
I would expect the Next Distributor would be reasonable. Its a decent company who will be experienced about such matters. They will be glad to be done with the case. Your choice whether you decide to push Next for your son's car repairs - or just tell Next you'll drop the claim if they agree to tell Admiral they have no claim against your son.
I take it your son got the driver's reg no, & name as well as the photos?
Although bear in mind the accident was on roundabout so the Next truck is probably not fully liable. The split may be 50/50 or bearing in mind the damage is to the front of the OP's sons car I'm guessing it was hit by the middle to back of the trailer so they may dig their heals in and dispute liability0 -

Yes and I see no reason to contact 3rd party's insurer ourselves as sure if my son attempts to make a claim they will too. Lose-Lose; don't ya just love insurance? Interestingly, AdmiralLaw (their 'Law' firm) sent my son a letter asking him to contact them to make a claim and the only part HIGHLIGHTED in this letter is about making a claim for 'injuries' (whiplash anyone??). So much for the ConLib's 'crackdown' on this type of thing which we are all paying heavily for! I am mentioning this to the FSA (already mentioned it to Admiral Insurance who 'apologised' for it lol) and just sent a copy to my local Labour MP, who I am sure will take it up on my behalf with the coalition, when he gets back from his 'summer' holiday(s).0 -
Unfortunately, you can complain all you like but it will only receive a boilerplate answer.
Insurers and personal injury lawyers have been locked in a very political battle over this for the last 18 months (called the Jackson Reforms).
What I am saying is that if the Law Society, the Solicitors Regulation Authority, APIL, MASS et al, have pitched battle with BIBA, the ABI, many Lloyds of London syndicate insurers etc. and are still locked in battle (have you seen the 'Don't Get Mugged by an Insurer' advert?) what chance do you think your complaint will make?
Don't waste your time, just do what you are supposed to, which is report to your insurer and just let them sort it out.0 -

Thanks. I threw in the towel about 10 minutes ago. Have emailed Admiral, BUT still complaining about HOW they have handled this; which has been '!!!!-poor' at best! They now have all 3rd party details we have, which is the same as they were given on the 16th but acknowledging that they will contact 3rd party insurer and HOPEFULLY lay this thing to rest or whatever happens, happens. Incidentally, my son has been with them 3 years, this is 4th, but he had a problem with this years renewal end of July: details wrong, cost wrong 3 times, misquotes, adding/deleting cover, # phone calls made etc. I complained and this morning I got a cheque for £30!!! Makes me feel somewhat better and will pay for phone bill at least.0 -
Another issue with a lorry. The driver may or may not know what the load it that he is carrying and may not want to stop just in case.Censorship Reigns Supreme in Troll City...0

I'm thinking that just because this happened on a r'bout "the Next truck is probably not fully liable" is a bit of a stretch.
These are matters of fact not precedent. Whether an insurer looks carefully at fact really seems to be a lottery though.0 -

An accident on a roundabout without independent witnesses would typically be 50/50 so it's not "a bit of a stretch" especially if you throw in that by the sounds of if the truck was on the roundabout before the OP's car.0 -

It might typically be 50/50 but that doesn't mean it should be.
Liability and negligence are supposed to go hand in hand. The insured is getting a raw deal from his insurer if he is deemed the liable party just because it suits the claim handler to get it off his desk quicker.0
