Benefit fraud advice

  • Because at the time the properties were negative equity, and knowing that one day they would not be, she agreed to walk away if he took on all the debts of the property as well as all the profits. Yes at that time all 3 were in negative..

She took the TV... That is all...

    She just wanted out.

She also didnt want to make the occupants of the 2 other properties homeless (at that time my grandmother was living in one of the other properties, she moved in with Charlie after the divorce so he could rent out hers)

However now as she forces the sale, she is going to specify that out of the equity of the properties, she wants Charlie to clear the debts (as it's his furniture now) as per the divorce agreement, and she wants 1/3 of the equity because she's entitled to it. He should have got her off the mortgage earlier. She is not entitled to 50% though as he has lived there without her for 5 and half years though...

Hopefully, despite being done for Fraud being one of the worst things that have ever happened to her, it could be a godsend in disguise, as this could be what is needed to force Charlie to sell, get her off the mortgage, and as she's innocent she should not be done for fraud...

2 massive weights off her shoulders...
  • We got a phone call today. Whatever the solicitor said to the court today must have worked as my mother has been granted legal aid!
