    Since the phone call from GPB Solicitors, I've received nothing.

    It may be a little too early to tell, but I'm hoping that this has gone away.

    Hi all,

    A quick update to this (although after 18 months I would have thought MET would have dropped this).

    I realise there are some users out there screaming “NOT ANOTHER DEBT COLLECTION COMPANY QUESTION” but please bear with me as I believe this is slightly out of the norm (due to the age of the alleged debt & the fact that I’ve been through the Roxburghe chain mail saga)

    A couple of weeks ago, I receive a new payment chasing letter. Not from Roxburghe this time, but Debt Recovery Plus (letter dated 19/9/2014).

    Having done a bit of research about why MET might have changed Debt Collections companies, I’ve found out that Roxburghe had their renewal of a credit consumer license denied by the OFT and have subsequently gone into administration (16th September). [I would post the links, but apparently, as a new user, I'm not allowed to.]

    I’m assuming that MET have just passed all the unpaid cases across to Debt Recovery Plus?

    Today, I receive a "Notice of intended court action" from Debt Recovery Plus. Part of me thinks that this is just the start of the obligatory Debt Collection Chain Mail saga” but only with a new company.

    However the other part of me sees this as something to be concerned about as these guys seem to be a little more together than Roxburghe / GBP. They've followed up within a couple of weeks, which Roxburghe never did.

    To make matter more interesting, since my last posting, darling OH has been offered a job down under and she leaves at the end of October with me following in a couple of weeks time.

    This adds to my concern as;
    (i) If DR+ were to recommend court action to the solicitors and they proceeded, I wouldn’t be in the country to receive court papers
    (ii) IF it did go to court, I wouldn’t be able to represent myself (not being in the country)

    As I see it, I could take a couple of actions. Back down and give the drivers name (she’ll be in Oz by then) or, continue to ignore. Personally I think the second option is a bit risky due to not being able to answer court papers if they were to arrive.

    I’ve been through most of the posts regarding this type of incident - in particular an incredibly useful one from Coupon-mad but they don’t seem to apply to this situation (i.e. Moving, Age of Alleged Debt, New Debt Collection Copany)

    Any thoughts would be greatly appreciate.

    Correct!

    This won't be going anywhere near a court - just an empty threat to get the reaction you are starting to display. This is definitely an 'ignore' - see NEWBIES FAQ sticky, post #4.

    Are you leaving the country on a permanent basis? If so, you won't even see their letter chain drivel, forget about it.

    What's the worst you are worrying about - deportation to Australia?

    We're going on a 457 Visa which, apparently, allows you in the country for 2 - 4 years. However, I've know people go over on this Visa and never come back. I've no idea if it will be permanent.

    I did read that Newbies post (wanted to post the link, but wasn't allowed :naughty:), but as I'd already gone through the chain mail saga with Roxburghe and that this was DR+ I thought it might be a slightly different situation.

    Having followed the link in Newbies #4 to PiPePoo...I am tempted to write an "appeal" anyway along the lines of;

    To DR+
    I deny any debt to MET....etc etc

    To MET
    Dear Sir

    Ref ****

    I wish to challenge this notice and refer you to the consequences of Halsey v Milton Keynes General NHS Trust if you refuse to consider an application outside your normal deadline.

    The amount you claim does not represent a genuine pre-estimate of any loss

    If you do not accept this challenge, I require the validation code to refer the matter to POPLA
    I will require you to produce the contract that you claim has resulted in a payment of £100 by you to the land-owner.

    I would love to sign off to these with something like"By the way, I'm off to Oz, so best of luck getting any cash out of me"...but I know that would be tempting fate..

    You are taking them far too seriously, MET never takes anyone to court and DRP can't take anyone to court.

    Anyway, if you want to stop them completely in their tracks wait until you are in Australia and write a letter to MET (ignore DRP) giving them your new address. They're completely screwed then, can't issue a MCOL against an Australian address.
