Faulty Car Section 75

Hi

With a car thats faulty purchased on a credit card, can the claimant claim for the whole purchase amount or just the cost of the repair?

    How long have you had the car? Price paid in total not just on the card?

  • Basically engine fault that'll cost around a £1000 to repair, purchase price was over £4000, with most of it paid on credit card.

    Question is under section 75 do I have the right to claim whole amount or just the repair cost? thanks

    depends also on engine fault, was it negligent e.g no oil
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.
  • fault has been accepted by card company, what I'd like to know is how much claim to put in, the repair cost (£1000) or the whole purchase price (over £4000)?

    That affects whether you have a claim for breach of contract (ie claim cost of repair), or attempt to reject the car (ie claim refund).

    Sounds like you can claim for the full purchase amount, up to 6 years after the original purchase. Might be hard to prove that the engine was faulty at the time of purchase though. Used cars have inherent risks and if the dealer didn't give you any guarantee, I don't know if your claim will be successful.

    I understood the law has recently been revamped and you now have 6 full years for rejection, with no reason to give for doing so.

    Are you hoping to keep the car, get £4000, spend £1000 to repair it and keep the £3000 profit?

    I hope that's not possible.
    loose does not rhyme with choose but lose does and is the word you meant to write.
