Paking ticket on broken double yellow line

Hi All
I have been working in Leeds and parked on a street where they had been painting double yellow lines. I arrived late evening and parked on an unpainted section. The section was large enough for my car with no part of my car overhanging any line.
Next day I was given a ticket.
Do I have grounds for appeal?

    You certainly do. You have not parked in contravention (unless you're in a controlled zone) and thus the officer has acted vexatiously.

    Under those circumstances you may be able to claim compensation from the council via the adjudicator as they had no right to issue you a PCN.

    I am of course assuming that this PCN is for a code 01 - parked in a restricted street during prescribed hours.

    As I say though if you were in a controlled zone with possible other things in force (such as conservation area where lines aren't needed) then you'd be done for. If this was just a case of no lines existing and it was just a normal yellow line restriction then you'd be ok (assuming the council hadn't coned off the road for painting etc).

  • Thanks for the replies. I did take several photos and the car is clearly parked in a break in the double yellows. The contravention was for a 01 parked in a restricted street during prescribed hours.
    I sent an email as detailed on the ticket telling them I want to challenge the PCN as no contravention occurred.
    Guess I will just wait and see what they say.
    I didn't include it on the email I sent to the parking department.

    Remember, to be legal, both single & double yellow lines must begin & end with a T bar. Failure to do so renders the entire length of yellow lines unenforceable.
    The lines must also be unbroken, so no gaps where they have yet to complete the painting, or where the lines have been worn away by people walking over them.

    If the lines had not been finished, you could have parked right on them with impunity. As it is, you parked on an unpainted section.
    Looks like the Council have messed-up badly on this one.

    Thats incorrect. It was the case many years ago (and I'm talking in excess of 10) but it certainly isn't now. There is no requirement for them to have an ending T bar at all and there is also no requirement for a "At Any Time" sign either for DYL, Many councils are now removing these signs.

    It would certainly appear to me that they have messed up. Another car further down also parked in a gap in the lines was also ticketed twice!
    How would one go about claiming compensation? Compensation hadn't really crossed my mind but when you think about it. It takes time to appeal etc, I had to move my car and its all stressful......

    I think seeking compensation is a bit dramatic, I'd just appeal the ticket.
    Some times you have to hold back to go forward to where you want to be.

  • Hi,

    I am not so sure you will get anywhere with this. They are most unforgiving I parked with 1 wheel out of a marked bay by 4 inches and all my appeals failed. That was in Wiltshire picking up a prescription for my Mother. All the photos etc no joy ended up with with a £60 fine.

    Any way good luck hope it works out for you.

    Yes, just getting off with the ticket would be fine. Just one reply mentioned compensation so thought I would ask
