Looking at the court success thread, it does seem that TC have a habit of throwing in the towel just before the hearing. But 100%? Just Google "Jeff Halsall"!0

I'm not siding with the airline, as I don't know of their success rate, but just so you know Mr Halsall was actually unsuccessful at court (despite what the papers said).
TC agreed out of court to pay the Article 7 compensation but disputed additional 'damages' that were claimed for him and his wife.
I've seen the judgment transcript and court papers and the case was completely mis-reported.
Moral: It's possible TC are telling the truth.0 -
That's an interesting corrective. Though I suppose it's also fair to say that TC are unlikely to offer to settle if they don't think you have a good case.0

Five weeks since I withdrew the court hearing date and still no payment from TC!

The settlement was offered by TC subject to withdrawing from the hearing.
I can re-activate the hearing for another date if I don't get the payment.
Apparently the head of the in-house legal time has not yet authorised the payment.0 -

A more suspicious mind might conclude that it was more likely they weren't across their facts, and wanted you to postpone the hearing to give them time to get their evidence together. Regardless, the experience of others on this forum is that if you keep the pressure of the court date live, it concentrates their mind on swift payment.
It cannot take five weeks to authorise a payment offered in settlement of the case. So I fear you are being taken advantage of.0
