can we be prosocuted even if we pay back the money.
The council can (and always has been able to) prosecute under the theft act.
Most council's will withdraw the discount, issue a new bill and take action to recover the amount through the normal process however they may prosecute for theft. Each local authority is different.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0 -
I've never received such a letter in the 10 years I've been claiming the single person discount.
I got one last year and on enquiring it's a new system (certainly in my area, not sure about others) where Capita have taken over the administration side of the SPD.
I had to have a telephone interview to "prove" I was living alone.I have a simple philosophy:
