Thanks for the helpful replies, we also felt it was a bit odd but that's why I turned to MSE to give clear, sensible and supportive advice at a very stressful time.Taking on the world one debt at a time!!!

If there was a diesel spillage, mud on the road or some kind of detritus left by another then you may have a claim. It's a bit of a hurdle to prove though.
The same goes for local authority, if its down to some highway defect.
I think you are mixing up the old who sues who with a passenger can sue the driver/husband/wife et al. A driver cannot sue himself for negligence though!0
