£5K isn't enough - I think he should sue himself for every penny he's got.

    That'll teach him a lesson! LOL. ;)

    I see one flaw there.

How would the legal costs be met?

    He'll be out of pocket.

A nice bit of whip cash will make everything better.

..Been advised by a few people he should claim compensation, essentially suing himself. I'm a bit suspicious about this effecting our future premiums, has anyone else done this? Is it financially worth it?
    Most definitely.

I will take on this case on a "no win no fee" basis.

I'll put in a claim on behalf of your husband against the driver for £50,000 damages.

My fees are 30% of the damages = £15,000.

That will be financially worth it.

    For me anyway. :D
  • Thanks for the helpful replies, we also felt it was a bit odd but that's why I turned to MSE to give clear, sensible and supportive advice at a very stressful time.

If you read what you need to know , not what you want to read, then it is true you have had clear sensible and supportive advice.

Ibuprofen will cure whiplash in a few days, some take a bit longer.

I have been out to the chemist and bought a family pack of Ibuprofen :j but nowhere does it say you can claim £2500 for claiming against yourself for being a !!!!!! driver (allegedly) :( oh well, have to look for something else to earn money on ?) hey what about suing for whiplash :j yipeee
  • If there was a diesel spillage, mud on the road or some kind of detritus left by another then you may have a claim. It's a bit of a hurdle to prove though.

The same goes for local authority, if its down to some highway defect.

I think you are mixing up the old who sues who with a passenger can sue the driver/husband/wife et al. A driver cannot sue himself for negligence though!
