Virgin Atlantic delayed flight VS006 Feb 2012

Has anyone tried to claim for the severely delayed flight Miami-LHR on Feb 4 2012? I have been fobbed off with a letter stating that this had been cleared through the courts with Virgin Atlantic not being liable due to "extraordinary circumstances".
