Restaurant keeping staff tips

The restaurant I work in have decided that they are 'losing money' due to unspecified 'staff inefficiencies' and are therefore suggesting they want to keep all staff tips for themselves. Tips all go into a pot & get shared out weekly based on hours worked.
Can they legally do this? Surely the customer leaves the tip with the expectation that its going to the staff who served them, not as yet more added to the price on their bill?

Never argue with stupid people, they will drag you down to their level and then beat you with experience.

Arguing with idiots is like playing chess with a pigeon: no matter how good you are at chess, its just going to knock over the pieces and strut around like its victorious.

Tell the customers not to leave a tip and that the staff don't get it. That will stick it to the company.
Are the company using the tips to pay you with?

If they are stating in a menu that staff get all tips they are lying. We’ve had to remove your signature. Please check the Forum Rules if you’re unsure why it’s been removed and, if still unsure, email forumteam@moneysavingexpert.com0 -

No, tips are over & above min. wage; and they don't state anywhere anything about tips/gratuities.Never argue with stupid people, they will drag you down to their level and then beat you with experience.- Mark TwainArguing with idiots is like playing chess with a pigeon: no matter how good you are at chess, its just going to knock over the pieces and strut around like its victorious.0 -

Sharing it out isn't unreasonable as it means the kitchen staff also get a share.0
