Sports direct consumer rights

Hello am looking for your help please people.

Yesterday I went into sports direct and bought a pair of trainers for my daughter along with a pair of trackie bottoms. On taking them home and getting her to try them on they didn't fit.

I returned to the shop today and got another pair which do fit her but they didn't have the tracksuit bottoms in a bigger size.

The difference worked out at £14 which they refused to return to me as cash or back onto my card. Surely this can't be right, I left very unhappy with a gift card.

I still had my receipt the bag and obviously the goods were returned as they were purchased.

You are not entitled to a cash/card refund as there is nothing wrong with the item's, refunding on a gift card is acceptable

You don't have a statutory right to change your mind when you buy goods in store. Technically they could have refused to do anything if they wanted to. Unless they have a returns policy that allows you to get a refund then there's nothing you can do.
  • Ah that's rubbish, I thought if you weren't happy with goods and you still had receipt you were entitled to a full cash refund. They obviously aren't fit for purpose as hey don't fit.

Oh well Lesson learnt don't use sports direct again.
  • It's not that I changed my mind I just wanted different sizes, and they couldn't offer a replacement for the tracksuit bottoms, I did manage to change the trainers to the right size though.

You did change your mind - You changed your mind on size.

Unless goods are faulty, there is no need for the retailer to do anything at all. It's not very fair to say you'll never shop there again when they've already gone above and beyond their statutory duty!

I can understand why you might think you are entitled to a refund, but the problem (if it can be described as a problem) is that most shops give us way more than they are legally required to. It makes shops that don't do that look like they have bad customer service.

You do easily tend to think that all High Street stores are good at returning things.

Unfortunately Sports Direct are not in the same category, they obviously just want to pile it high and sell it cheap. Time will tell if it affects their trade.

They obviously are fit for purpose as they aren't faulty and do exactly what you would expect from them. The fact you chose the wrong size doesn't make these ones not fit for purpose at all.

    No - that's the law!

At least you now know your statutory rights so you won't be caught out again.
