Hey at least we're friendlier than the lot on the unmoderated ebay boards who are giving a certain questioner a mauling at the moment.

Just wondering if the OP has got anywhere? Maybe you should ask to get the balls back so you can settle the dispute, shoulder the cost of getting them posted back and then find out if they are ivory or not - if he's just trying it on the you need to contact ebay and tell the the situation as you really are being backed into a corner here, looks to me like it should be give and take and you will have to give first by sending him the money to post the item back, after that it is all depending on whether the item is ivory or not??

I agree with Rachie I think it is too late now for the OP to have any bargaining power, this should have been dealt with back in February when the complaint was made. The OP cannot prove they are ivory, he only believes they are as he was told that by a family member. They were however sold as 'ivory' which may or may not break ivory trading laws anyway.

The OP has already offered a refund, but on his terms. The buyer does not use paypal and the seller has offered a refund by paypal only. That will of course incur charges on the buyer, ie the initial (small) cost of having a payment taken from your authorised account, the charges that will apply when he received the paypal payment as it cannot be done as a refund due to the fact that the buyer paid by cheque. Any associated costs in his own country of withdrawing paypal funds and losing out on the echange rate when he converts. As a buyer I would expect a refund in the same way that I paid, ie a cheque for a cheque, paypal for paypal.

I can really only see one way out for the seller, and it is one that I don't think will be popular. Pay to have the billiard balls returned, make a full and final refund of all payments made by the buyer by cheque in the buyers own currency. I can't see ebay letting the seller get away with any less now whereas possibly back in February the seller may have had more leverage for negotiation. I think that is the only way the OP will get his ebay trading account back.

    sorry all,was away with work.
i have received no word at all from ebay since the initial 2 emails on saturday (despite contacting them daily through the site and replying to the emails,as they suggest).
i have managed to find emails for the buyer, and have been in touch to arrange a refund,so that side is at least ok.
why on earth havent ebay at least got back in touch though ?> when you fill out their online form, querying a suspended account is one of the options.
i contacted them via a friends login, and got a reply within 12 hours saying we cant discuss other peoples accounts etc.,fair enough but why wont they talk to me ??
    any ideas,anyone ??
    cheers

You might want to just tell Ebay to FO if you think the buyer protection payout was wrong and just re-sign up using a different credit or debit card AND a different email address, and ideally a very slightly different name - eg j t smith instead of j smith.

Scammers do it all the time...

And they get caught all the time as well.

The OP made a mistake and is trying to clear the problem and move on, good for him. I'm not sure that suggesting he acts like a scammer and against ebay rules to stay trading is helpful.
