Item sold on eBay not as described

Hi all,

Just wondering where I stand with regards to my problem I have.

Sold an item on eBay recently and once the buyer received it, he said it wasn't actually what I sold. The problem I have is how to resolve this issue. I bought the item off eBay a few years and used a similar description to that of the item I bought.

The item was a replica Wrestling Championship belt and I bought it under the assumption of it being a version 2 but have only realised that its Version 1 having the buyer bring it to my attention. Also on the listing I stated that returns are not accepted.

I genuinely had no idea it wasn't a Version 2.

Where do I stand on resolving the issue?

    If the facts are that you misdescribed it, you need to give a refund on receipt of its return regardless of what you said about no refunds. I fail to see why you are asking here, and why you think it is a problem, as it surely is a moral obligation not to screw your customers over, as well as a legal one...
  • If it is not as described (it is) then they return it and you refund them. a good seller would refund their postage too as it was sellers fault for the incorrect description.

    You either do this now or they open a SNAD and ebay will tell you to do it.

    There is an ebay board on here. They may be able to tell you advantages/disadvantages of waiting for ebay to tell you.

    I understand what youre saying but I was fully of the understanding that it was a version 2. The pictures accurately picture the item and if the buyer knew this wasnt version 2 when it arrived he should of noticed from the pictures?

    This was your fault. You wrongly described it. You will have to refund. You can relist it properly and sell again.

    Sorry, the others are correct.

    Where you purchased it from and what it was sold as has no bearing on you selling it on.

    It's your responsibility to make sure your description is correct and you can either refund the guy (as well as making sure to pay postage costs to have it returned back to you) or you can wait for the ebay/paypal case to be raised against you. One that you would certainly lose.

    If you didn't know then surely you can understand the buyer not knowing?
    It's possible they know nothing about these things but have bought it as a present.

    Stop trying to find a excuse and accept the buyers been missold the goods and deserves a refund and for you to pay return postage!

    Imagine this.
    You buy a 64gb iPhone 4S from a guy who bought it from another guy.
    When you plug it in, you find that despite looking very similar, in fact, identical, what you actually have is an 8gb iPhone 4.
    The guy you bought it off didn't store stuff on there and so didn't notice the capacity issue, and as iPhone 4 & 4S are identical aesthetically, didn't notice the difference in model, and advertised it based on the description he had when he bought it.
    You, rightfully, want a refund. He says "no, I advertised it honestly. I advertised the phone I thought I had"

    Can you see the issue here?
    You described an item as "version 2". It isn't. Either you refund, or the buyer goes through eBay/PayPal and opens a dispute based on "item not as described", and wins.

    Unfortunately, ignorance is not a defence you can use to sidestep the rules.

    Is there a way on eBay to officially refund a buyer without them raising an item not as described? If not, does OP run the risk of refunding, and then having to refund again if the buyer also raises a dispute with eBay?

    What is the difference between version 1 and 2?
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')
