getting my deposit back for a cancelled bespoke suit

I ordered a bespoke suit from a shop, and was measured up for it. A price of £315 was agreed and I left a deposit of £150.
Several weeks later I went for a fitting and not one item fitted me, it was all too small. I requested then that the jacket be made longer than i orignially requested. A couple of days later i got a call from the shop who were then asking for an additional £100 for the new jacket as it will have to be made from scratch again. I was very unhappy with having to pay an additional cost for a new jacket as the original one was too small, i could hardly button it up and the sleeves were too short.

I decided to cancel my order because of the additional cost and because i had lost confidence that they could make the suit to fit me anyway after the first disasterous fitting.

I have asked them for my whole deposit back, but I don't know if they will agree to this. Just wondering what my rights are and if I can successfully argue my point as i won't be receiving any part of this outfit now.

Thanks.

Very limited if the suit has been made to your personal specifications and not just off the shelf.

that's why they have fittings, so they can adjust the item correctly for you.

Obviously you changing your mind cannot be grounds for a cancellation without financial consequences.

If it is truly a bespoke suite then there would be a number of fittings (3 is the most common) and it is inevitable that it wont be 100% on the first one.

Normally for a bespoke you'd have another 0 in the price and still you wouldn't expect it to be perfect in the first fit.

If they have not made the order to how you specified, then they should rectify this at no additional cost to you.

If you are now asking for something different to what you originally ordered, then it is only fair you should pay.

What length did you specify, and what length is it?

I presume you feel that as they have made it too small and will no doubt have to re-make it anyway, you'd like it to be made differently from your original plans?
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

Something else that isn't clear your original post, did they measure you and tell you what size you should have, or did you tell them the measurements yourself?

this would depend if they are making the suit (bespoke) for a particlar person then like a wedding dress for a bride their will be various fittings to get it correct, which could see it lengthened or shorthened, sometimes if they may need extra material that may cost extra, but depends what they told or in any agreement with the buyer.

    but then the OP stated
I requested then that the jacket be made longer than i orignially requested.
so yes they can request extra as he has changed the order.

just think like this, you go and buy a shirt that costs £20, but you have to come back tomorrow as we dont have your size, so you go back tomorrow and then you tell them please can you add a tie. fine but we will need an extra £5 for the tie. are you going to argue about the extra money request as it was you who changed the order.

If you was measured up and everything was too small, irrespective of you asking for it to be longer, surely the suit doesn't conform to contract and can be rejected?

Of course these sorts of things require more than one fitting and the shop may have terms relating to sizing and rectifying such situations - so see what terms are in place first (is there any notices up in store or anything?)

I would agree with that, but the fact he went for a planned fitting and then it was the OP who asked them for a larger jacket, they could argue that the OP has changed the order

Not in this case, because the normal process will involve a number of fittings. It is only if an acceptable suit is not delivered after a reasonable number of fittings that you can say that the suit does not conform and may never conform.
You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'

Agreed with Valhaller, even then you have to give the person the chance to "put things right".

I wonder which came first the request to make it longer or the perceived not fitting?
