  • I wouldn't be surprised if this was all hogwash, funny how TWO newbies come along and both hate the same company! I guess these are bogus people to trash the name of a company they are in rivalry with. Shame on you. I've reported you both x

    Are you from WAE+?

No they don't. The exact wording used in the regulations is:

    http://www.legislation.gov.uk/uksi/2000/2334/regulation/14/made

makes no difference as they cant refund until they are in possession of your money

i will be telling the OFT and TS to consult users on MSE before they say anything.

Reported for what. Correcting your error?
If that one word doesn't make any difference, why did you add it bright red and underlined font?

As i deal in cash offline and my ecommerce sites only deal with items made to customers specs then DSR does not apply

The Distance Selling Regulations state that the seller must refund the customer as soon as feasible possible but within 30 days".

    The reason feasible possible is

    1) You pay online for an item on Monday using worldpay
    2) Worlpay does not pass the money to the retailer until the following Thursday (10 days) to make sure it clears without issues.
    3) you get the item delivered on Tue. ( day after ordering)
    4) decide its not you or its faulty.
    5) so you return this the following day
    6) seller gets this back on Thursday and agrees to refund you.
    7) the seller then needs to wait until he gets your money cleared and in his possession from worldpay before they can refund you.

The point you are missing earthstorm is that the goods are never delivered and the cancellation only takes place once the delivery date has been passed - up to two weeks after paying for the order.
So your list for delaying the refund does not apply - as soon as possible should be immediate.

Anyway, the word would have been feasibly not feasible !!

so as the retailer does not have hold of your funds then how can he refund.

It works like paypal that the refund get processed as soon as the incoming funds are fully cleared , so depending on how quick your processor works in getting you the funds, this is why the 30 days is their.

like 2checkout will hold the funds for 2 weeks before releasing them to the service provider/retailer. they says its a fraud prevention incase of chargebacks

I noticed that, but as earthstorm appears to report any post that disagrees with their advice, I thought it best not to mention their spelling as it might give a legitimate reason for the mods to remove the post.
Because of this, I simply made my post factual in pointing out their misunderstanding of the actual wording used in the DSR's.

I guess you just can't help some people.
    Sorry I tried.
Please ignore my warnings and place as many orders with WAE+ as you can afford to live without.

i think the main point is as soon as a possible reasonable explanation is give the user (post 5) turns up and has not been back since. this looks suspicious

But WAE+ does have the funds in most cases because, once the published delivery date has passed (5-7 days) they fob you off with 'another 7-10 days' and try the same again when that time has passed. I expect most people are well into their third week of waiting before cancelling and requesting the refund - ample time for any credit card company to forward the funds.
    That's a definite maybe! :grouphug:
