This is weird. As you point out, ParkingEye have accused you of ignoring all correspondence, but now say they have issued you with a POPLA code. Did they send you a full copy of the letter they say they sent? If not, it's worth asking for it.
Plus also, please do tell us numbers 4-7 because these are the coded date the code was issued.Dedicated to driving up standards in parking0 -

Received curt response re appeal via mway services
PE referred to an attached letter dated some months ago - that gave popla code but now out of date?Have not appealed to popla at all (appealed to pe in August) they never said yes or no!!
Question was whether to appeal to popla as over 35 days?

No point appealing to POPLA if the code is out of date. Did you check the middle 3 digits as explained on the Parking Prankster site?
How can PE have sent you a rejection letter when you had not appealed? It makes no sense! How is their old letter with the old POPLA code worded then? Can you quote it please, surely at the start it doesn't talk about 'your appeal' and that they've 'rejected it'?

I am concerned about this. You had a Letter Before Action some time ago.
From what I can make out on the thread, you then appealed to PE in August, AFTER you received the LBA, but have not had a reply? If that is the correct sequence of events, then your appeal to PE was way out of time.
More importantly what is happening with the LBA correspondence? You had a letter from them, did you ever reply to that letter? And what happened next?
You MUST keep the LBA correspondence going and keep pressing them for the Practice Direction information - if you take your eye off the ball and don't respond, they can issue court proceedings.
So please tell us:
1 where you are up to with the LBA correspondence - ie what date was the last letter, and was it from them to you, or you to them?
2 re the letter about the POPLA code, people have asked you to check the digits or post them so they can be checked for you. This is so you can find out when the code expired (if it has expired)
3 if the registered keeper was NOT the driver, there is still time to identify the driver, in which case the procedure starts again and the driver gets the opportunity to appeal to PE and then to POPLA.

If you are not the driver inform them who is, they haven't issued a small claim yet, under the Protection of Freedoms Act 2012 you can name a driver up until a claim is made. Send that via their form and snail mail with proof of postage.
If they issue a claim knowing that it's against the wrong person as you have discharged your liability they will have a torrid time at court. Do this now don't wait for anything else.When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

I agree with Stroma - *IF* the RK was not the Driver, send the letter below to PE, do it today. Please note: we are NOT suggesting that you tell lies about this.
If the RK was the driver please can you give us a time line of every letter sent between you and PE starting with the Letter Before Action showing the dates of each letter so we can get a handle on where you are up to with this. D

I refer you to para 5 of PoFA 2012 - as legal proceedings have not yet been started, by providing a servicable address for the Driver, I have discharged my obligations under PoFA. Any subsequent proceedings that may be issued against me, as the Registered Keeper, will be defended accordingly, and an application to strike out made on the basis that the claimant has no cause of action against me.
I consider this matter to be closed.
