OneStopPhoneShop sent me wrong colour of phone

Hey all,

Bought a clearance D900 from OnestopPhoneshop the other day and it came today. On the website it was the black D900 that was shown but the one they sent me was the red/'wine' colour one which i do not like. Do you think i have a case for making them send me the correct one?

I thought, perhaps as it is a clearance phone they may have a disclaimer somewhere saying that its not guaranteed that you'll get the same colour and so on but i can't find anything like this - the only thing i can find is one saying a memory card, data cable etc is not guarantee to come with the phone.

Give them a call, said you are not interested with this colour. If they refuse to change it, then you should be able to cancel this contract during this 14 days period.

I received the same. Obvioulsy they only have red stock.

IMO the red will be easier to sell on when you've finished with it.

..but phone them up anyway and complain and tell them that you would be happy to accept it if they compensated you to save them having to take it back etc.

Ok thanks i am going to but do you happen to know any specific law that i can use to try and argue my case?

I tihnk, if you ordered a black phone and was given a red one, you've got a valid case if it wasn't expressly stated that you may get a red one. I'd imagine you'll be fine - give them a call and explain and they'll be fine. Don't go in all guns blazing though - no-one likes being shouted at for something outwith their control!
