Customer compliance interview for undeclared benefits (I think)

  • Yeah you are right MissMoneyPenny. He is going to discuss doing that tomorrow when he visits CAB.

    I don't think a month is very long in these situations.
    Did the CAB advise him and did he take their advice ?
    Did his Dad offer to bail him out ?

  • His dad has offered to write letters or go with him to any interviews and explain that he thought the savings he set up for his son was already taxed or whatever it was he actually said about (can't remember exactly what he said) and that it didn't class as income.

    I am sure he would help out with finding a lawyer if need be too.

    My bf contacted CAB a few weeks ago. Tbh they weren't very helpful. He gave them all the details and asked how much a rough overpayment would be and the possible outcomes and they basically said how the hell should we know? Maybe he just got a newbie that day because they do sound like a group that can help.

    Wouldn't his savings count as capital (and not income) which will reduce the money you/him should have been given for income based benefits? The tax you pay has nothing to do with claiming income based benefits.

    I always thought that CAB staff were just volunteers who don't have the expertise on most matters?

    The only way to know what his overpayments will be, is to ask the DWP and the local council to calculate them.
    RENTING? Have you checked to see that your landlord has permission from their mortgage lender to rent the property? If not, you could be thrown out with very little notice.

  • Yeah we now know that his captial wouldn't be regarded as tax free or whatever his dad thought and it would count towards what he was entitled to.


    His friend done a rough overpayment calculation and for JSA, CT and HB it came to around £8000-9000 but like you said, we wont know fir sure until the officials get back to us

    What did he do with the £17000 he only had for a couple of days? Spent £3k on a lappy and has £5k left - what happened to the other £9k in such a small space of time?!

    I have been trying to work out where the £9,000 went to. We haven't bought anything extravagant (other than the laptops you know about). He took out a grand in the summer of 2011 when we were waiting to apply for JSA as we got into serious housing arrears while HB was getting set up and the rest of the money left from the grand he took out went towards messages, elec/gas etc as we had literally no money coming in for about 4 weeks as the claims were getting set up. He also done the same last year too. He didn't this year as his savings were getting low and wants to keep them for an emergency (which ironically will be his overpayment now!).

    How long does it usually take for the compliance team to get back to you? Will they send a letter out stating how much needs to be paid back or do they refer it onto to some other department?

    Also, will the letter be addressed to me since I was the main claimant this year or to him since it was his ISA?

    Sounds like he knows exactly what he's been doing - even to the point of hiding several thousand pounds from you and the DWP! He even seems to have known to get his savings down to below £6000.
