Conservatory being built - whose fence is it?

Live in detached house. The back garden fence attaches to my house and runs parallel to the house (in a continuation). So looking at it - the fence is on my land.

Having a conservatory build and want to replace part of this fence with a wall (i.e. the conservatory). Can I legally do this?

Obviously, I'mn going to ask my neighbour but is he allowed to object? It would just mean replacing fence with wall. Othewise, even if he does object I can build conservatory 1" inside fence and he can't do anything anyway.

    I guess you mean a wall up to the conservatory roof, unless you want the neighbours having full view of you in conservatory? In which case, you may exceed the rules on non-glazed percentage and it would be classed as an extension.

    You may need a building warrant if closer than 1m to boundary (certainly in Scotland) and a party wall agreement if on the boundary.

    Strip foundations are normally 600mm wide.

    Party wall act comes into play, you would do well to research that, as I did on KS's advice when faced with a similar issue a couple of years ago;)

  • Well, spoke to my neighbour and he wasnt bothered to be honest. Happy for me to extend my wall outwards as a solid side to the conservatory.

    I will however read the bit about the party wall act.

    So what % needs to be non-glased for it not to be a conservatory?
  • Ah. Apparently, conservatory is not less than 75% of roof area is glass and 50% of walled area so I think I'm ok.

    Yeah, the point really is get the neighbours ok, the foundation do have to be and can legally be on the nextdoors land. Make that under the....land.
