The "C" stands for conditional not certificate.

    Conditional Offer of Fixed Penalty:o

Always better to look up rather than remember.

I hate FLAs and TLAs ;)

YE i wouldnt contest in court if you've( your oh i should say) admitted it to a copper.

Why do people do this? Its alot more common for police to report people than let off with a warning. If you learn the law you can atleast get off with it in court!
  • Hi all, thanks for the quick responses! Sorry was travelling on a train & saving the bit of battery left on the mobile.
Ok, so to correct myself, what I have received is not the fixed penalty notice, but notice of intended prosecution. Reg the `Notice of Intended Prosecution `, it is dated 08/08/13, but the alleged offence was on 18/06/13. I am the registered keeper and not changed addresses for over a year so am surprised they took so long to send the notice. Of it should have been sent within 14 days as some of you advise then sounds like I have a case. So am I correct that I need to fill and send that back and wait for the fixed penalty notice?
    Cheers

You will have to name the driver & return within 28 days... this is a different issue to the alleged speeding charge & must be done.

Find your V5 (logbook) & check that registered keeper details are correct, in particular the Doc Ref. No at the bottom of the inside page.

    For your partners nip.

    I stand to be corrected. but I think in a 40 mph zone its 10% + 9 = 53.

So 56 is outside the SAC option.

You have 28 days for them to receive it, so you must send it back with 2 or 3 days to go, so wait a few days for advice.

Go to peppipoo and post your question in the speeding & criminal offences forum, there is an NIP wizard to fill out.

If the dates are correct a simple speeding allegation should not have been issued, You may have to send a letter pointing this out with the correctly filled in NIP, but check at peppipoo.

Re. your first incident, you cannot be prosecuted for speeding unless a) you were stopped by the police and warned of the possibility of prosecution at the time, b) there was an accident of which you were aware, or c) a Notice of Intended Prosecution was issued to the registered keeper within 14 days.

Assuming a) and b) not to have happened, and you state that you are the registered keeper, it does seem as though the police have messed up with this one. However, definitely get it checked out over at pepipoo.

Re. the second incident, I don't think it makes much difference to the outcome - but your wife must make sure that if she goes for the postal option, she returns all the forms with the requested information (including financial forms and her mitigation).

A notice of intended prosecution is required to be served, not issued, within 14 days. The notice that the OP has received may be a 'reminder', and the original had not been served - but proving it is an up-hill struggle.

An SAC (speed awareness course) carries no points, but costs £90, and some insurance companies now ask if you have been on one (which pretty much makes them pointless, a situation which is being "looked into" also you might argue that an SAC is extra training to make you less of a risk.......)
Wow that's interesting! Not that they even have 'speed awareness' courses in my area - they don't everywhere.
Oh and another vote for pepipoo here
