    well they had to when i used the service anyone on MSE are not the law and cant think they are.

    that is the problem with MSE users they think they are on a consumer forum so they know the law.

    Actually I've been through the legal system before.

    How to take your claim to court

    You may have to go to a court hearing if:
    • the person or business says they don’t owe you any money
    If they admin to owing the money then you issue CCJ without a court hearing

    That is correct. But you said they have to admit they owe it to get a judgement. That is incorrect. Based on that logic, if a debtor persistently denied a debt a judgement would never be able to obtained in the creditors favor.

    If the debt is denied as this quote states, then the case will be heard by a judge.
    If the claim is ignored then you can apply for judgement by default. Very easy to do if the claim was submitted online.
    If the claim is defended and the defendant doesn't attend the hearing then the judge will hear the case in their absence.
