Capital Hire Ltd experience so far.. Any advice?

Hi guys,

Recently hired a minibus from Capital Hire Ltd in Marylebone. First impressions were good. I told them I was planning to drive around Europe, and eventually the bus was driven to my property by a representative of theirs who sat down with me and, whilst holding the contract, read out 'the important bits'. Again we discussed my journey. I paid for the hire in full, plus a £350 refundable deposit.

The vehicle was returned to them two weeks later, and an inspection was carried out, at which point the reprentative told me everything was fine and I'd definitely get my deposit back. He signed a sheet of paper to say I had passed the inspection and when I asked for a copy I was told there was no photocopier. Luckily I took some pictures of the signed document.

I called the office and again was told my deposit would be back in my account within 4 working days. When I checked this, I found that not only was it nowhere to be seen, but £200 had been taken from my account without permission, due to 'excess mileage charges' which I had never been informed about!

In fairness, at this point I checked the contract and there was a mileage limit imposed on the vehicle, but this was never mentioned to me. I would assume, however, that they have a duty to supply me with a vehicle appropriate for the route I was taking. Surely also, they should be informing me before taking money from my account?

In addition, they also took £200 from my Credit Card. The twist here is that I had paid my credit card off in full the morning I hired the vehicle; I attempted to pay the £350 on this card, but was told it had been declined. I assumed the money had failed to clear yet, so just paid it on my debit card instead. However they had obviously stored these credit card details without informing me/asking permission, and then decided to deduct a further £200 from it, again without informing me or discussing it.

Do I have any rights here? I have disputed the matter with the company themselves but they have so far ignored my emails/letters and keep fobbing me off on the phone. If anyone has any advice it would be much appreciated.
