If it's in the "warned list" for a certain week then it is already at the Crown Court. Mags Ct doesn't do warned lists.
Surely it would have to be quite a large amount to go to the Crown Court. I know of two people, one stole £8000 the other stole £10000 (in 3 days and it was his third offence) and neither of them were tried at the Magistrates Court. They did plead guilty at the first opportunity though so maybe that's why!0 -
Fraud is triable either way and can be heard at either magistrates or crown. The OPS daughter herself may have opted for trial by her peers in crown instead of by magistrates.
It sounds to me like a case with fundamental difficulties. Normally by the third hearing I would expect the CPS to have been roasted out of court by a Judge tired of time being wasted.
Force your solicitor to give robust answers. If they are not recieving proper disclosure, then this matter cannot proceed.0 -
As Weird Nev says, fraud can be directed to the Crown Court if it's too serious for their sentencing powers, or the defendant can choose to be tried there - irrespective of the seriousness of the case.
The OP's solicitor has told the truth about when the applications to dismiss the case can be made and I see no point in changing solicitor for this reason.
The judge is unlikely to allow the case to be dragged out much further. Without knowing details of the case, of course it is impossible to speculate the reasons for the CPS's delay. It could be inexcusable staffing levels, or it could be e.g. a police delay behind the scenes for which they bear the brunt.0 -
hang on in there. sounds to me like the CPS took this on and is now realising there is no chance of winning. which is why your solicitor was offering a 'deal'. they want a 'result' and was hoping your DD would be willing to deal to get this case over with. your solicitor was only doing his job by passing this on to your DD.
from the sounds of it there is good chance of the case being dismissed. and then you could take this ex-employer to a Tribunal.0 -

I wouldn't advise any details of the case to be posted. The case is before the courts and therefore sub judice.0
