yes another MSE user than know more that Trading Standards.
I would trust TS rather than anyone on this forum. either way it did the trick, just got call from Openreach engineer that he is working on the issue now.0 -

TS were right, your contract is with Sky and not BT OR.
I would take issue with TS advice that there should be a 24 hour deadline given. That I would deem unreasonable, as would Sky.0 -

yes been dealing with Sky ALL weeks with false promises of an engineer being assigned to fix this by BT openreach (who are contracted by Sky).
Because of all the false promised I sought advice from TS as they know the law more that MSE users ( although some MSE users do think they know the law more that the law). after providing all the evidence to TS they stated that as i was not getting service paid for and they were not getting this fixed then Sky were in breach of contract and i could give them 24 hours notice that they breached contract and therefore if we wanted we could leave without any contractual penalties. The fact it was the second time in 3 months of so called line issues has not helped them. yes Sky could disagree, but as this come form TS they could do nothing.
But just the mention of that worked as an OR engineer called us to see that he was working in the issue. 2 hours later the engineer turned up at our house to explain what he found he could not find anything from exchange to junction box, so he needed to check our box into our house and this shows fault so he checked pole and nothing so this pinpointed it was the cable from our house to pole, so he changed this cable and so far all working.
Sky are also not happy at the length of time it has taken to fix this issue0 -
TS have no power to enforce a resolution time, in the the same way they have no power to enforce the ability for you to break contract.
I'm sorry, but you can say all you like about MSE users, but to say TS told you you could break contract if it wasn't fixed within 24 hours might be true, but in the reality its not enforceable.0 -

They do have the power to force a company to carry out something in a resolution timeframe.
just like that can walk into a shop and state that them items are not safe remove them and if you dont they will remove them.
They can deem a company has breached a contract and act on this. Its part of the Unfair Contract Terms Act 1977 that a company must fulfill its contract and sort any issues out in a reasonable time frame, but as 2 major issues with Sky and a week of false promises then Sky are in breach of contract as they are not providing the service paid and agreed too.
i work very closely with my local TS regarding contract and TOS as with my hosting business they checked my TOS when i set it up and when i need to make an amendment i will ask them to check that, so to make sure it companies with current legislation. I was the one who asked them to do this, which they were happy to do.0 -
Are you going to leave Sky as a result of this?0

Let me put it in a way that might make it a bit more obvious.
If TS worked in the way you claim, there would be no purpose or point in Ofcom.
