cifas - how long for and is there any way I can contest?

    CIFAS flags certainly won't be kept on a credit report for life. By law personal information has to be retained for a reasonable period of time only. The precise retention times may vary according to the type of case being recorded. For any specific case the CIFAS member involved should be able to provide more information.

  • Somethingcorporate - you are right in some ways, I would have known it was a dodgy cheque but he didn't know it was (no common sense), so he was not meaning to commit fraud by cashing it.

    Thanks James, that puts my mind at ease a little - however this happened last May so shouldn't it be off by now?? My partner had his application for a new current account refused last week.

    It sometimes can be the searches. I had a few searches last year for credit cards - when I went to apply for another bank account I was declined.

    It may not just be the CIFAS.

    I also can not see how you would contest. It seems he knew exactly what was going on. If someone sent me a 5k cheque I would be thinking where on earth has that come from?! We generally know that money is coming to us if people don't they must be very lucky.

    0 chance of a CIFAS marker being ignored for a mortgage. 1 default is hard enough even with low balances.

    James, what creates the variability? I'd have thought CIFAS loadings had a standard time to display other than policy a victim status
  • I agree samtoby, think he just doesn't know things are too good to be true sometimes when they slap him in the face! In all honesty, if I was the bank I would have done the same. All I'm really concerned about is that this 1 mistake doesn't penalize us for life.

    I'm also going to contact National Hunter as I've heard on another forum that their records can stay with you for 6 years. At least then we'll have a better idea of when we might possibly be free of this...?
  • Little bit of an update... today the CIFAS report for my partner came through, it was as expected a Category 6 'First Party Fraud' recorded in May 2012.

    We then went to the bank today with this information and have got them to open a case to have it removed as the 13 month time period (which is the norm for CIFAS entries to be kept on file) has now elapsed but the entry is still present. They said they will be in touch with an answer within 10 working days.

    Hope they might now take action and remove it... will keep you posted :)

    Is the matter fully closed or still under investigation? I am thinking along the lines of how the cheque came into his possession. Possibly other lines of enquiry are connected.
