Whilst awaiting my response from POPLA which will be in October ( which is ridiculous) I decided to email The Range and make them aware that their store car-park which is covered by Parking Eye is breaching the rules set out by the BPA in a couple of areas, one being no entrance sign and the terms and conditions signs not situated throughout out the car park, I informed them I had photographic evidence and expected them to respond with what actions they would take with Parking Eye to ensure they met BPA's rules.
Anyhow, The Range replied stating that they are unable to comment on Parking Eye as the company is not linked to The Range, they stated they appreciate the car park is used by The Range customers however the car park is privately owned and not the property of the Range.
Seems a bit unusual as The Range seem to have parking eye in all of their car parks, so it gets me thinking then who the "loss" is too and is The Range's response correct?
At another store An article in the Wigan Evening Post recently, a parking eye spokesperson stated they used parking eye.
Im going to respond back to The Range but before I do wanted your thoughts.

Which car park is it? I bet if they took anyone to court at this car park then pe would soon produce a witness statement from the range authorising parking invoices etc on tis land....

I'd certainly hang on to that email, and should PE produce one of their Witness Statements purporting to come from The Range then someone is lying, and I'd put PE to proof that it wasn't them - by producing your email from The Range.

One point though.
The land may not be owned by the Range. The Range may have a long lease. So technically they mat be right.
This is something to keep in mind with their witness statements.
I bet they would get the supermarket or similar to sign off as the landowner and, although they may have appointed them, they are not the landowner.
So, when a witness statement comes in, we should always advise MSE members to check who the actual landowner is and, if it is some property company who has let the land on a long lease, I bet they won't know a thing about the parking contracts of their tenant and the PPC. And if the lesee has signed as landowner, the witness statement is fraudulent.0 -

Actually, did you demand to see the contract in your appeal? If so, what has the PPC provided in their bundle re that point?0 -

I know.
But my point is that the POPLA witness statement has boxes for signatures from the landowner. So if the Range sign as the landowner, they are lying.
Then we ask the PPC to submit a contract from the landowner to the Range that grant permission for the lessee to instruct agents to charge parking contraventions.
And so it goes on.0 -
Hi, the store is the Bolton store, the car park is shared with two others stores a tile shop and pet store, but the letters from Parking Eye refers to The Range Bolton Car Park. I have sent a response and will update you when I hear from them.0

This is the emails I've had with The Range below.
Firstly their reply to mine pointing out the breaches

Thank you for your email dated the 3rd August 2013, regarding Parking Eye.
Unfortunately I am unable to comment on the policies and procedures used by Parking Eye as this company is not linked to The Range. On speaking to staff within Parking Eye I have been reassured that all guidelines are followed in accordance to the British Parking Association.
If you have any concerns regarding a Notice you have been issued you will need to discuss this directly with Parking Eye. I appreciate that the car park is used by The Range customers however the car park is privately owned and not the property of The Range.
Therefore if you were to be issued with a notice and wish to appeal you would follow the steps documented on the Parking Notice and provide your Proof of Purchase where your case would be considered.
Please accept my apologies for any inconvenience this matter may have caused you.

Thank-you very much for your reply, thanks for the advice but I don't have any concerns regarding a parking notice and I have not asked you for advice regarding a parking notice.
I contacted you to make you aware of breaches by Parking Eye in a car park used by your customers.
Can you clarify, you state the car park is privately owned when I raised concerns about the breaches in the rules of the BPA by Parking Eye.
So who is responsible for the car park and who should I make aware of the breaches if Parking Eye are not linked to The Range, who has requested them to operate in the car park used by yourselves? If it is yourselves then you need to be aware that Parking Eye are not abiding by the rules and I refer to my initial email that it should be rectified. I apologies if it is not yourselves but Parking Eye give that impression.
Parking Eye may have reassured you but I can tell you categoricly that there are breaches, please don't dismiss my concerns by stating Parking Eye state they follow the guidelines, they have not done at the car park I refer to.

So they will not answer the simple question of, have you asked Parking Eye to operate in your car park, and to accept my point that if they have; they need to be aware of their breaches in the BPA.

"I contacted the Range and enquired if they had appointed Parking Eye as their parking management company. They declined to support Parking Eye's contention that they were."
And do check who the actual landowner is through the council.0
