*disclaimer* I'm not so much wanting advice here as support and a way of venting a wee bit...

Ok so current tenancy is coming to an end, ends on the 15th and we want to leave for various reasons so that's all fine.

So due to having certain requirements in what sort of rental properties are suitable, such as proximity to work, kids education and having 2 dogs etc we were limited as to what was out there. But lo and behold a perfect place came up for rent at the exact same time we needed to properly find one (as opposed to finding perfect place too much before end of tenancy and losing it due to that)...

So we filled in the forms, and LL was happy to rent us the place but explained that due to the current tenants being 'awkward' there were a couple of issues. Now they are being legally evicted (not sure why, and they won't tell us which is fair enough) and were supposed to be out last month, but didn't go. Oh well we thought, and kept looking for properties but nothing came up and like I said we have requirements that are not flexible. Then they were supposed to leave this week, but are now saying they won't leave til the 14th.

Now due to certain things having to be organized and booked in advance we have had to book the removals van already for the 14th (to leave the 15th for extensive cleaning of existing house), plus notify various places to change bills, phone etc over. You can't just wait til the day before and expect removals firms to be free etc can you?

But now we are like <sweary word, more sweary words> as we are due to move next week but for all we know we will get to the house and the current tenants will still be there, with no intention of budging until they get dragged out by the sheriffs! Cue stress overload!!

Now our current LL's are selling, so we do need to be out of here and I have absolutely no intention of being the type of tenant who does not leave when arranged, I don't want to be a problem plus I wouldn't want to have to pay another months rent when I may only be in the house for a few extra days IYSWIM, and so I fully intend to stick by our agreed leaving date.

Like I said I don't want advice, I know this mess is partly my fault but by the time we found out that their initial 'out or else' date was last month, then finding out today they probably aren't budging until we are moving in, and the fact they are being evicted means a) they may not have left at all and b) IF they have they probably won't have been too good about leaving the place in a nice condition................... although out of the 2 options that is preferable to us having a lorry load of stuff, 2 kids, 2 dogs and nowhere to live we had no time to find anywhere else, and go through all the paperwork malarky!

So yes, hallelujah for me managing to get myself into this mess

Speak to your current landlord. He may not need you out on the day in question.

Personally I would ringing the LA/LL and finding out exactly what stage the eviction procedure is at.

I am presuming you are in Scotland?

If you look on the Scottish Shelter website there is a good outline of the procedure.

Once you know whether it is going to be a few days or a few months then you can plan ahead - family/friends/storage/travel lodge/similar/another rented place - does the LA have any short term lets?

We've been told the 14th is their absolute last possible date, all eviction stuff stops being 'friendly' and starts to get 'forced with large bailiffs' at that point. They have said ok and they will drop keys off with LA in the morning of the 14th but then they might be lying! And as they did have a legal tenancy they can just stay until they get dragged out, which depending on who is doing the paperwork at the courts could take ages!

We (based on work, dogs etc) have no other options for places to live, only family are a long way away, no friends with ability to house us let alone dogs in this area either. Essentially I would have to close my shop, give up my job, rehome dogs, take kids out of their school/college and pay a fortune in storage.

My head is going to explode!!

If we stay beyond the 15th we will be putting ourselves in the same situation as the **** in the place we are moving to, in the way we will be evicted/unwelcome.

Our LL is not nice (one of the reasons we want out asap) and so won't help with our current problem.

sorry to say that if you handed notice in, you're in a worse position than the tenants in the place you want.

they are in a tenancy which the LL is trying to end (requires court)

you have ended the tenancy (by giving notice), which does not need the court, and cannot be undone without the LL agreement.

if you stay past the date you gave notice for, the LL can charge double rent (look up "holding over")...

I hope this works out for you, but could become a right mess, I would start looking for a plan B.

I know, that's why we are so stressed. We had to hand our notice in so the LL would know we weren't going to renew our tenancy as obviously they should be warned as they would be asked for references once we started proceedings for new property. We couldn't just up and leave on the 15th without them knowing, not just because it would be rude but impossible.

What else could we have done, we've done things as 'properly' as we should but are coming unstuck due to tenants in future house.

ISTM that Plane B was always going to be storage and hotel

whilst organising it in one week instead of two might be a rush I can't see how it is impossible
