I don't think CPM Carpark Management do court:

...and if they tried then most small fry PPCs would be fairly easy to beat IMHO. You are likely to just get the usual flurry of rubbish debt collector threatograms which you can ignore now. Keep ALL the letters for up to six years as evidence in case you ever need to respond to a court letter or Letter before Claim. This time, take our advice!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Without wanting to sound as a doom mongerer Coupon Mad, but as this could remain 'valid' for 6 years, if CPM do start taking people to court then could they potentially pick up historic cases like this and start pursuing them through the courts at some point between now and 2019?This is my *anonymous* account on MSE Forums - I post under a different username normally.0

Could be true but it is all about weighing up the additional costs that could arise against settling now, should that happen.
The additional costs, should it get to court and the motorist lose, are not worth the alternative of settling now - at least not in my opinion.
And OP would, hopefully, be better prepared and advised should that happen.0 -

Yep which is why they should keep all the letters, just in case. This is NOT a time to just fold and pay, despite the way a POPLA decision is worded. Even if a PPC tries court later on, under POFA 2012 they are limited to claiming only the amount of the PCN (plus nominal court fees) and they wouldn't necessarily win in court. I firmly believe a small-fry PPC would be easily seen off, if this poster took advice in time...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
