Parking ticket on private land what to do next??

I received a parking ticket on 19th July 2013, issued by CPM Carpark management while parked on a private housing complex.

I am a Locksmith, and was called by my customer who was locked out of her flat. I parked in her designated bay and went up to the flat to let her in. I was gone probably 15mins. When I returned I had a parking ticket on my windscreen and a fine of £100 or £60 if I pay within 14 days. I immediately wrote to them and challenged the ticket.

My case was that I had parked in the correct bay used by my customer. There was no way of obtaining any sort of visitors permit as this was locked in the flat. I did get a permit when I had gained entry and managed to show this to the warden, who was still on site and explained to him my situation. They are now saying, that they have assessed the claim but that the ticket is still due, and I have the next 14 days to pay.
I feel this is unjust and un fair.

I would be very grateful for any advice on what to do next?

    Okay have you contacted them at all? Have you admitted you were the driver and given them your contact details ? If not wait until the notice to keeper which must arrive within days 29-56. And for clarity is this lot ? If they rejected your appeal have they given you a popla code?

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

  • First things first. You WON'T be paying this, so don't worry about discount periods - irrelevant.

    No operator by the name of "CPM Carpark management" exists on the BPA AOS Members list. However there are many similar. Is that the exact name? Do they claim to be BPA members? (If they are not, you shouldn't have contacted them at all.)

    If they are, they should have given you a POPLA code to appeal to them. Have they?

    I wonder on whose authority they are claiming this ticket is valid (that's kind of rhetorical, as they'll come up with all sorts of BS to justify their existence). They ONLY person who can make any kind of claim against you is the landowener, i.e. the owner of the flat whose space you were in. So, she could sue you for £100, or whatever, at which point you simply bill her back for that amount as part of your business costs.

    That's how daft the position is. CPM can take a running jump, but you may as well cost them the £27 POPLA fee in doing so. Research here and get your appeal reviwed before sending it.

    CPM are wasting your time with this, and i asume that that as a locksmith then out and about you have a call out fee plus an hourly rate. have you thought about charging CPM for wasting your time?

    Thanks for your replies. I have been told on the letter that I can appeal to POPLA but they havent given me a POPLA reference number? They have the BPA logo on the letter.

    They also state that if I do appeal and it is unsuccessful the I lose the right to pay the reduced amount of £60 and will have to pay £100.

    Their full name is CPM UK Car Park Management.

    Contact them and demand the POPLA code or cancel your ticket.

    State your appeal point as per your initial post and ask them what would have been their solution to your situation.

    Reasonable request.

    No-one of that exact name on the BPA AOS list. They are probably being dodgy where it comes to company registrations and names - nothing new there.

    As for the POPLA code, check carefully on the letter. Some companies do provide the code, but so hidden and obfuscated, you wouldn't know unless you look. Is there a 10-digit number lurking somewhere on the letter, where the 7th digit will be a 3?

    Like I said, forget the discount rate, and what they are threatening. YOU WON'T BE PAYING THIS.

    Just to be clear. Have you had a letter to your name and address at home from these people. It should say Notice to Keeper.

    As far as getting your name and address, normally that would be through the DVLA, but if you have a sign writted van, they didn't need to do that.

    In any event, DO NOTHING TILL YOU GET A NOTICE TO KEEPER and let us know if it has a BPA logo on it.

    Surely its worth asking the customer if they have title to the designated space, if yes then its theirs to do with as they wish without a mere ppc harassing their friend/contractor.

    I haven't had a letter titled Notice to keeper. I only have the original ticket and their response sent to my address, to my appeal, stating why they have rejected the appeal. I have double checked the letter and there is definatley no Popla reference.
    I have sent a letter back today requesting a Popla reference and also their BPA number to prove membership. I await their response.

    And you won't get one. GD probably missed the fact that you appealed directly to the Notice to Driver, so no DVLA request or NtK was needed.
