Immigration Company - Can I claim for lost costs?

    while the company updated its website with details of the change two days after it was announced,
    But the company could argue that they placed the new changes on their website, so have provided details on the new changes. It is not upto telephone advisors to keep mentioning this.

    Can you image if you phoned your telephone/utility company and they had to keep telling you of all changes, you would soon hang up as how much is this costing you before you can even get to speak to the advisor with what you want to ask.

    its not comparable - one is an ongoing contract and another is a specific service for set tiem and reason.

    it is the same as the changes were not just for them it effect everyone.

    all retail/service sites will have TOS etc., but if you call them then they dont go through every one of these or all changes, it just would not be viable, placing these on their website is all they are required to do.

    In the period after details of the changes had been placed on the website, the adviser discussed details of the application with the OP without being aware that the application could not be submitted because the law had changed. This is incompetence of the first order.

    I suppose the change in law is outside of the company's control. If they had told you earlier, what difference would it make? Does your contract with them mean they have to inform you of all legislation changes?

    Unfortunately she needs a special visa to get in to be allowed to enter a civil partnership or marry.

    The flight was mainly to take the documents - sending it by post would cost £80-£100 to ensure it arrived safely and even then, I'd not feel 100% so I used miles and an additional £110 to taken them in person and yes, kill two birds with one stone and spend a couple of days together.

    But I only booked it once my advisor told me the application would not be a problem and we could work to that timeframe.

    If they had told us earlier of the changes - even just a chain email to inform people that new laws were coming into place and everyone should read them to ensure it wouldn't affect their application - I could have flown 3 days earlier and we would have been able to apply as we met all the previous requirements - if we felt we would not have enough time, I would not have booked the flight, ceremony, got documents, etc.

    The certified documents are going to be pretty useless now - I'm not sure if they expiry but won't be needing them for anything else.

    We could still meet the UK law but she would need to do a new test and the next one near where she lives is in October and it takes 1 month to get the result so we ended up getting a Schengen visa for 6 months multi entry that allows us to go to most European countries, a few which allow same-sex partnerships so we are going down that route.

    Once we are married, we can apply for a EEA family visa which is free and can take 1-2 weeks to get a reply - this is opposed to the £850 fee we were going to pay and the 2 month wait to find out the outcome.

    I thought I should go via the UK route as I am part of the community and it has been my home for the past 12 years. In the end, it will probably work out for the best but it has heartbreaking and disappointing as I really felt the company did not do what they were supposed to.
