Immigration Company - Can I claim for lost costs?

    Yes of course she doesn't have the same rights as me - what I meant was that we could go somewhere to get married and bypass the UK law - we wanted to do things properly because even though I was not born here, I am part of the society, I pay my taxes as I don't take anything from the government unlike many that are born here do.

    And yes, immigration is tough on Russians and a couple of other countries - even the stereotype against them is quite clear to see here.

    Yeah sure - if we want to take the risk of being attacked or killed for wanting to be with the person we love.

    It's funny how someone that needs advice on a customer issue - ends up on this.

    Not that I'm surprised - gay couple plus Russian citizen - I guess it's not just there that we should be worried about being attacked.

    You do realise that this is not a consumer rights issue that crops up here very often?

    Perhaps you should be seeking answers from maybe a forum somewhere that tends to concentrate on this type of thing.

    Maybe a solicitor is better placed to give you the advice you need.

    Yes it's not your every day problem - I thought this would be a good forum where people may be able to help instead of attacking and judging. At the worst, I thought I wouldn't get a reply.

    If someone does have some helpful advice, I would appreciate it and I shall seek advice elsewhere too.

    If anyone is interested to know, she got a visa to go to my country where we will be allowed to get married and we will then apply to the EEA family permit visa and she will join me in the UK.

    I'm sad that you have received so many ignorant responses: the intelligence of the people who were unpleasant is shown by their failure to read the earlier posts, among other other things.

    To answer your question: you can certainly write to the general manager of the "advice" firm to complain and to ask for a financial settlement, and probably you would receive an apology, a bit of money, and perhaps a bunch of flowers! To get more than that you would have to at least threaten to issue court proceedings, which costs fifty pounds is very easy to do. If the issue actually came to court, anything could happen. My guess is that the judge would order the refund of most of what you paid in fees since the service you were given was sub-standard, but your main concern seems to be money that you lost because of this (consequential losses), and it is unusual for companies to be ordered to make payments in respect of this kind of thing.

    Anyway, your main concern is surely how to find a way to be together, and pursuing an incompetent firm of advisers for money is not going to resolve this but will just drain energy from you. Speaking as someone who is entirely British born and bred, I think that this government's behaviour on race and immigration is deplorable and that they have now forfeited all claims to be treated with respect. In your position I would not hesitate to use your EU citizenship to avoid the extortionate visa fees and conditions that are now imposed, and simply find somewhere where you can register a marriage or civil partnership giving you access to the EEA family permit.

    I have already started a letter to the company and will most likely send it off - more than the money, it's the principle too.

    And yes, our main concern is being together - 2013 has been so heartbreaking but we're finally just over a month away to flying over to my home town and filling the papers for our ceremony and we just can't wait.

    It's a company that will help you with a visa application.

    They can't guarantee that the application will be successful, noone can but they are supposed to help you gather all the documents that you will need to support your case.

    All the information can actually be found on the UK Border agency but there's a lot to read, a lot of small things that could get missed, laws can change at any point so they are supposed to know it all and keep up to date.

    Visas will be declined on the smallest technicality so they are supposed to ensure that you got everything covered.

    They can't provide evidence like photos, communication, earnings and savings, etc but they can ensure you got everything needed to have a good case.

    For example - there is a British Vicar that is married to an Ukrainian women and she is an English teacher but her visa was declined on the basis that she did not meet the English speaking requirements. A good immigration company would have spotted that her english qualification is not part of the approved list and she could have done a test to ensure she met that requirement.
