Is it that hard to dismiss an employee?

Not made redundant but dismissed for not performing to requirements set.
Staff get monthly reviews so it's not like, I'd go into work tomorrow and be called in and told to leave and not see it coming.
Still you have to pay notice if you are told there and then you are not needed anymore. We’ve had to remove your signature. Please check the Forum Rules if you’re unsure why it’s been removed and, if still unsure, email forumteam@moneysavingexpert.com0 -
You cant see the sack coming, or can you?
Still you have to pay notice if you are told there and then you are not needed anymore.
If you are regularly being pulled up for things that are not correctly and these get brought up on your reviews, you'd be a bit silly not to think that you need to improve.
You've answered my questions, yes, notice must be paid and that's what we have been doing so we are following the rules.
I just wanted to ensure that was the case.
Trust me, I don't want to see people dismissed but if they are jeopardising the company and all the good employees, then there's no choice.0 -

Yes I think this person will be - guess amongst other things we will get her a free alarm clock - let's see if that will fix the daily lateness.
Lateness can often be caused by caring responsibilities. Does the person in question have dependents they need to sort out before work? Maybe negotiating a later start/finish time would be appropriate for this employee.
As am earlier poster said, bad HR practice and training can be the cause of dismissals as often as incompetence so it's worth exploring any issues before resorting to sacking someone.0 -
I know in mine it mentions warnings and gross misconduct, don't recall anything about being paid my notice.
I will have to read mine although I've been in the company for 6 years now - some of the new staff have only been for 3 months and have been given revised contracts.
It doesn't need to say anything about being paid notice. That is your right which could not be taken away from you even if the contract said otherwise.
Your written particulars of employment should include something about notice periods - those due from you and due from your employer. In the absence of anything written there then the statutory notice periods would apply - one week from you and, currently, 6 weeks from your employer. Your contract may require more but the company cannot give you less than one week for each completed year of service.
If an employee is dismissed within the first two years of employment, they are entitled to one week's notice unless the written particulars say more.0 -
It's amazing at the amount of people that can't perform - some things are down to individuals like being late everyday, not being capable of signing off their name or even putting the dates down correctly.
A lot of people seem good enough to hire - it's after the 2-3 month period when a job is just a job for them that they stop to care and try to show that they want to learn and improve.
Well just wanted to know what those rules are and looks like my boss is following them correctly.
Many thanks.
Then the company need to start managing them, not letting it slip and then getting rid if they aren't up to scratch.
If they are paying them off then more fool them.Sanctimonious Veggie. GYO-er. Seed Saver. Get in.0 -

The relevant date is 6th April 2012I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -
