    If this is covered under SOGA then I could see that the OP's condition may change what is deemed a significant inconvenience. However as it is second hand, they are down to whatever Samsung are willing to offer.

    The phone is at the warrant repairs service....they know of ALL the issues.

    I do have a backup cheap phone but it does not have the same conveniences as the samsung.

    Can I not get a replacement as this is the 3rd time gone for repairs in the first year:(...???

    Probably not. You have no statutory rights in this situation.

    You need to read and understand the terms of the Samsung warranty.

    Also, please re-read powerful_Rogue's most recent post and explicitly answer the questions posed there.

    In particular, what was Samsung's response when you pointed out to them that they had returned a phone with only half the memory of that sent to them?

    Is the phone faulty at the moment?

    yes.....samsung warranty service have it at the moment.........!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

    Have Samsung refused to repair the handset? No..currently at warranty service

    Have you advised Samsung they have sent you back a 16GB version instead of a 32GB? What was their reply?

    They did not believe me until i sent proof of imei and serial............!!!!!!!!!!!!!!:(

    How do I find out if seller was private or business....he has since relisted another exact same handset...???

    The suggestion re business versus private seller was made in posts #7 and #8.

    In any of his listings on the right hand side column somewhere under his username ( usually undr where is says Save this seller) it is state "Registered as a business seller" if it does not then its a private seller and you have less protection

    Maybe you could further examine his ebay selling history to determine if it is more like that of a business?

    But even if he is a business, as I said earlier, you will struggle.

    Firstly, you will need to prove that the phone he sold you is/was inherently faulty.
    As you now no longer have that phone (been replaced by one with smaller memory), I cannot see that happening.

    Even if you could prove an inherent fault, the seller can choose either a repair, or replacement or refund. Any refund could be reduced to take account the use you have had.
    The seller will choose the cheapest remedy.

    I cannot help but think you best bet is to keep on at Samsung to provide a phone that matched the one you originally sent them.
