PE charge cancelled by principle - court costs 'required'

Ignore them now, wait to see if they do file, issue a counter claim for £1 harassment to principle and agent, PE and Aldi, you will get your court fee back.
Sit back and wait for the counter claim to land on Aldi's legal desk.

Yes I have; had some initial responses but dried up now and still need to make sure my letter stops this nosense and need to send it imminently0

Their original claim for the PCN is still lodged with the court (or at least was when I rang a couple of days ago) so I still need to put a defence in. Question is whether it's 'the PCN has been cancelled, there is no longer a valid claim' or whether it's that PLUS all the usual?
I stand to lose by default if I don't submit defence0 -

The claim is by the PPC.
There is a conditional cancellation, but you have not fulfilled the condition to get it cancelled. The offer came from the landowner, the claim is in the name of the Parking Company.
If the offer was without prejudice, it may not be admissible anyway.
So, you decide as it's your money. Pay the £50 or if you think you can win, bang in your defence.
You are in the firing line and it's your money, so whatever you decide, no one else can criticise.0 -
I would go straight down the joint counter claim route by issuing a LBA of your own to both.
They "Aldi" will swat Parking eye faster than you can say "taking the mick".
With no foundation evidence they have no case to build.
The only foundation that they had was you owed a parking charge, this does not exist, they can not act in audience on behalf of a client and themselves when the client drops the charge.
The case has to have a foundation, the judge will throw them out in the first 30 seconds and they know this.Be happy...;)0
