PE charge cancelled by principle - court costs 'required'

Evening everyone
1) What are people's views on the wording of a letter to PE, politely declining their offer to help them out with costs they have incurred in starting proceedings only to have the principal (a European based supermarket) cancel the PCN?
I am 'required' to pay £50 costs or the claim remains and yadda yadda.. cut head off & put it on a spike in the Tower.
PE's letter is WP save as to Costs
Principal's letter is open confirming instruction to cancel PCN

LBA is non-compliant in terms of PD.

2) Claim acknowledged and defence due within the week.
All usual defence points collated but is my first defence that the PCN has been cancelled and therefore no case to answer?

I'm asking as I've actually compiled so much information, I need help whittling it down. It's like a thesis all over again.

Many thanks

Importantly, do I mark the letter Without prejudice in any way?

Was this supermarket Aldi by any chance? If it is, then this needs to be flagged up on Aldi's Facebook page as proof that even when the supermarket cancels the ticket, PE want their pound of flesh.

'Tis indeed - don't think I'm the only one by the looks of things, nor do Aldi seem overly bothered - almost implicit and shockingly brainwashed by a shedload of misinformation peddled by PE

If they persist in this I would be tempted to counter sue them for harrassment, and Aldi also! Parking Eye have been told to cancel this invoice, if this went to court they could probably be done for contempt. They would be insane to take this there, how can they do so without permission of the principle

In the meantime, what about the letter?

What exactly have you received from PE?
Was it a court claim to recover court costs for a cancelled invoice?
Was it just a begging letter pleading poverty and asking you to help or is it plain old harassment?

Been right through the process of PCN to LBA and Court Papers at which point contacted Aldi who instructed cancellation of PCN (got in writing). Then got letter from PE asking for £50 costs as it's my fault they have incurred them - I made them put the court claim in -if I don't pay in 7 days, the claim still stands and they're very confident they'll win. Interestingly, I've seen a couple of other posters with the same request but the way the £50 is reached is different - higher court costs but less in admin.
Anyway, need to respond in no uncertain terms that this won't be paid either.
And still need to ensure defence goes in so default judgement not given
    Thanks

Try ringing Aldi's parking department and give them a roasting. The best person to speak to is Laura Theobald (01793 836313) who seems much more sympathetic than Rachel Organ who I have spoken to. Rachel comes across as very aggressive and very pro Parking Eye.

I have had the pleasure of both ladies and agree with you assessment. Even Laura was of the opinion that they were within their rights to claim for costs as all Aldi could do was cancel the PCN. Rachel was rather more pro PE and was of the opinion it was a done deal regarding their success in recovering them

Have you also posted this on pepipoo.com? They would be very interested even if the advice given is the same.
