Please help with 3 contract!!
Hi, I was hoping someone could help me with a situation my daughter has found herself in with 3 mobile.
To cut a long story short she had 2 contracts with three, they messed up 1/2 price line rental and caused her bank charges after months of phonecalls etc she has finally gotten the 1/2 price line rentals she was due and a couple of the charges back. ... Anyway the nice lady on the phone when telling her she could have some charges back convinced her to take out two new contracts she recieved two new phones on monday, but has decided due to the service and problems she has had with three- she didn't want them any more- to be honest the contracts arn't that great and she has found better deals since.
I rang three for her and was told that the 14 day cooling off period is only valid if they dont put the sim card in the phones
apparantly there is a message played which my daughter doesnt recall hearing which explains this.
The guy I spoke to was having difficulty with the conversation and really seemed to be trying to get me off the phone, he also divulged all the account details (it isnt my account) without asking any security questions!
Basicly my question is do I have a leg to stand on here? can these contacts be cancelled within the 14 day period? Ive been on the ofcom website, but didnt really find anything that helps.
Sorry its so long!! and hope it makes sense!
Hope someone can help me with this
regards
vicky

In terms of the law no you don't have a leg to stand on and also three do make it very clear that the 14 day cooling off period applies if you don't touch the phone or sim make calls etc etc.
I think you will be stuck unless someone knows how you can wangle your way out of it.

The key part is:provided you have not used your mobile and have not transferred your mobile number to 3, you can return your mobile and original boxed accessories. You need to bring along your proof of purchase and do this within 14 days of the receipt date, and we'll give you a full refund.SLC: £13000+
