No it is not. You are wrong.
If there is no evidence supporting your allegation then they can reject it. Your suggestion of what is the case would be anarchy. A policeman says you were going 60mph in a 40mph zone. Using your opinion, the driver has to prove he was doing under 40. Whereas in real life, the police have to prove you were doing over 40. UK law does not work the way you say it does.
The evidence has to support your allegation.
Which makes your complaint about the weakest type going. The questions asked about sick pay and savings are there to see if you actually needed it or not. They are much stronger complaint reasons. Not some verbal allegation that may have happened but equally you could be making up.
Don't see why it matters to be honest, this is about the 3rd ppi reclaim I've done and they've all been successful.

It was missold, and it was not needed, but although we told them it wasn't needed they insisted we have it =missold.
I know what the questions were for, and I answered them honestly. And I still believe that they would have to prove, somehow, that they didn't insist the ppi was taken out, which they couldn't do.
Whatever the reasoning behind the misselling, it's still misselling.0 -
Here here Shopaholic2, you are right, the onus is on them to prove PPI was not mis -sold to you. I had similar success with my other PPI claims. Stick with it.0
