CCJ for parking fine advice please

Options
hi

I have received a ccj for a parking fine from ukcps. The car was being used by my fianc! dad who has also bought the car from February. Annoyingly I have got lots of tickets through because he seemed not to care.

I want to appeal the CCJ as I cant afford the 175 pound fine, and well cant really afford the 80 pound appeal but its a lot less, my question is in peoples past experience or knowledge will the fact that I was not driving the car and then sold it be enough to have the charge upheld?

The reason I did not appeal to ukcps was I ahd to pay first and I don't have that money to throw away and from research most people said they don't go to court.

thanks guys

Was it your car at the time?
    Did you correspond with UKCPS?
    More details needed.
    Did you appeal to popla?
    Was it before Oct2012?
    Did you get court papers?
    Did you contest?

Also I forgot to say that I do not remember getting a notice that it was going to court or if I did the letter must have got misplaced effort I was able to see it as I believe if you go to appeal they often get dropped which is a shame

That's a get out for the CCJ but others will point the way.
you could also post this on pepipoo.com, you will need all details of what you got.

    Get out of ccj?

I'm not sure the date as not on the letter and like I said there has been many through, so I can't be totally sure if was still in my name or not

When I rang ukcps to dispute I was told I have to pay to appeal and I did not have the money available

    What's popla?
And no not before oct 2012

Also the get out if ccj I assume you mean me trying to get out if what is my fault, which I'm sure it sounds like that and hence wondering if that's what a judge will think as I imagine it gets said alot, hence do I bite the bullet and pay and just struggle this month so at least it's not on my record and use it to remember don't bother helpin people out

    Pay to appeal?

Hang-on - You wouldn't be dealing with UKCPS if you had a real CCJ - It would be the court or the court bailiffs.

I smell a very big rat!

So tell us what the letter says exactly (personal/identifying info removed of course) and just who sent it before you dig yourself into an even bigger hole!

What was your fault? You say your car was being used by someone else so not your fault.
Go back to the start and make a list of what you rec'd and when, bullet points would help.
Popla is the ""independent"" appeals service used when an appeal to the PPC has failed (as they always do)
So after Oct 2012 then there is a system they have to follow and a time scale for all of it.
To make you (as RK) pay before appealing is against the rules so you can see why I ask for all details with dates.

The first I heard of it wa when I received a letter from ukcps

I rang a number which was automated intact my fianc! rang the number as I was at work and it said to appeal you must first pay the charge

I got more letters but ignored these due to the initial message

I now have received a judgement for claimant from Northampton county court stating I must pay £175

I shall attempt to find any letters regarding this and post dates

I assume you never rec'd the court papers from Northampton before the case.

No I haven't seen them or I would have appealed

Either they didn get her or my fianc! put it in side didn tell me or something like that, annoying as that appeal wouldn't have cost I don't think

Right, gather together all the info and list it, it will help others to word things so that you should get the CCJ overturned, and then get the ticket overturned. It has to be done in a certain order.
If you get any more in the future come back here at the start and don't ignore things.
