Solicitor enquiries

Options
Our solicitor has used a standard list of enquiries and then has asked some specific questions based on the survey. However, looking at the enquiries, nowhere has he asked about any previous subsidence or other issues. Is this normal ie. would you rely on a survey for those matters? The survey didn't identify any material issues.

  • My solicitor hasn't specifically asked about subsidence either. Also, I haven't been asked that by my buyers' solicitor.

    Perhaps it's not a standard question? I don't know other than what questions I have seen between the solicitors doing the conveyancing on my sale and purchase.

    do you suspect subsidence?
  • surely that'd be covered in survery... also i think theyd check if it was in an area at risk of subsidence

    I remember looking at a website where you could put in one postcode and find out for free as to what percentage it was at risk... trying to find it again

    Hi, no I have nothing to suspect subsidence - I just didn't know if my survey ought to pick that up and that's why it isn't included in the solicitors enquiries. I've looked on the home check website and nothing amiss is identified. Thanks all.

    Aren't solicitor enquiries based on responses in seller's enquiry forms?

    Is there a question therein about subsidence?

    If the vendor indicates there is no history of subsidence, is the purchaser's solicitor entitled to rely on the answer given, especially if there is no mention of subsidence in the surveyor's report?

    There is no question in the solicitor's form re subsidence

    Why would a solicitor ask about subsidence? His question will be answered by the buyer, who is not an expert, and may/would not recognise it.

    The professional involved is a surveyor- who recognises subsidence when he sees it. So assuming you had a survey done,ifnomention came up of subsidence that is the best professional response you will get.
