    The reason is that the appeal says that OP did not see any notices prior to the change. Now if there were, and they had been up for some time, as a regular user of the car park, OP could have been negligent in not observing changes that others had seen.

    That may not be in the OP's best interests if it ever got to court and OP may not want to use that point in a court case.

    Thanks guys. I will do. The adjacent car park is part of the same retail park separated by a canal.

    One other thing I noticed is that upon entering the car park, the warning signs are on the wrong side of the road. Are there any laws about which side of the road they should be placed?

    I agree, no need for 'without prejudice' at all as the appeal point is relevant and it just comes across as legalese. Shame the OP used a non-appeal at first when we have posted lots of times recently, NOT to use the one that doesn't have a definite appeal point (I always think bad signage is a good one, not 'it's punitive').

    The OP just needs a POPLA code ands a non-appeal wastes time and sometimes stops people even getting the code. When you get your POPLA code you can draft a POPLA appeal and show us first. Of course you'll be researching POPLA appeals already I hope, jay84uk, as we can't write them all and at holiday time we can't answer all posts:

    and as regards signage requirements you'll find the answers you need when you read the current BPA Code of Practice on the BPA website, which you will be best doing now so you are ready to cite it for POPLA. The entrance signage requirements are in an appendix on the Code but you'll need to read it all and pick out all the failures (and potential failures) by ECP.
