Ive noticed a few people have been caught out by the new time reduction to 50 mins from 90 mins at this particular retail park. Ive recently received a parking charge notice from euro car parks for being 18 mins over the alotted time.
Ive written an appeal letter in the following format which i havent sent yet
Dear Scammers,
In regards to the invoice received with ref number xxxxxx dated xxxxxx, the keeper denies all liability to your company as it is a punitive charge, thus a penalty! If you reject this challenge the keeper requires within 35 days a popla verification code for them to appeal independently, per Version 3 of the BPA Code of Practice.
The keeper has nothing further to add, and will not respond to any correspondence from your company unless it contains the popla code. If you wish to find out why else the keeper rejects your charge, pay the £27 plus vat to popla to find out
The challenge will be deemed accepted if there is no popla code on any rejection that you supply within the time-frame stipulated above.
But i have also read on a few threads about this particular retail park to contact a david fox at a company called savills who apparently own the ground and complain directly to them. Unfortunately i cant seem to find his contact details, could anyone help with this?
Any other advice would also be greatly appreciated

You would be best to get in touch with the local council to see that they had a proper planning consent for the reduction in parking time. Many examples of PPCs and landowners failing to do this.

thanks, I will look into this. Im not going to rush into anything, just trying to establish the best way to contest the fine before i do anything0 -
Just to add a little more detail to the incident so people can help.. The car park in question is a free but you must return within a certain time. Unknown to me this time limit has recently been reduced from 90 mins to 50 mins without any signs to warn otherwise. i over stayed the 50 min time limit by 18 mins.
The car in question is my girlfriends which i was using at the time. so the charge has been aimed at her and not myself.
I was caught by cameras photographing the numberplate as you enter and exit the car park. i received a letter approximately one week after the incident.

Ok, I sent a soft appeal like the one stated in my first post, requesting a popla code and I've just had this response...
Further to your email received XXXXXXX in reference to parking charge notice XXXXXXXXX (not an invoice)
The email provided below is not an appeal against the parking charge notice, therefore a POPLA verification code will only be provided when an appeal has been received informing of your extenuating circumstances, investigated and a response forwarded
The appeal must be received within 28 days from the date the parking charge notice was forwarded
As you are aware due to the changes in Schedule 4 and the Protections of Freedoms Act 2012 ('the Act') on the 01.10.12 if after 28 days beginning with the day after that on which this notice is given, the parking charge notice has not been paid in full, and we have not been made aware of the name and a current address for service of the driver, we do have the right, subject to the requirements of the Act, to recover from the keeper of the vehicle at the time it was parked so much of that amount that remains unpaid

You need a POPLA code, so write back and say you were unaware that the time limit had been reduced and you did not notice this.
Put Without Predudice on the top and ask for a POPLA code or dismissal.
Then send the refusal to POPLA and BPA with a complaint saying that the PPC is prejudging appeal points and you are reporting them for that.0 -
I've also contacted the land owner he has asked that I send him an email with the full details of the incident. Which I am currently going now.

I would put it on here as there are lots of very informed contributors - more up to speed than me - and they can pick up things that I might miss.
I would wait for the landowner for a couple of days to see what they say/do.0 -

Without predudice I contest the fine as this is a car park I use on a monthly basis and I am aware that the time limit for the said car park used to be 90 mins. It has recently been reduced to 50 mins with no advertisement of the change. Quite clearly this is an unfair and underhand tactic to catch out unaware drivers as the adjacent car park also policed by yourselves remains at the original set time limit of 90 mins.
I would now like a popla code or the PCN to be dismissed. I would also like written confirmation of all correspondence from yourselves

Are you able to confirm to me that you have applied for and been granted planning consent for this change and, if so, what date was this granted? If you have not, then I will expect you to cancel the charge.
If you have received planning consent, I require a POPLA code as I will be appealing on there being insufficient advanced notification of the change and other points that may emerge following further research.
Keep on checking with the council yourself, though.0 -
Why have you started your appeal "Without prejudice"? Do you seriously not want the contents of this appeal produced in court or are you just trying to introduce some fake legalese?0
