Solicitor still waiting for lease pack one month on.

Hi there,
Just wondering if I'm being impatient or if anyone else would be getting agitated re no movement on a (chain free both sides)sale a month down the line.
Not really sure who's at fault, but my sol has done some searches, but has only last week received some freehold info, but still has no lease pack from the selers sol.. It's now heading into five weeks since offer being made and accepted. Who should I chase, or should my sol be doing the chasing. It s an executor sale, so maybe this would make it longer?? I don't want to be a nuscience keep ringing, so maybe ill check what agent knows tomorrow. I've held off having a survey done Incase there was something in lease that made me not go ahead. Ie I cannot sublet it, as my plan is to rent it out.

IME your solicitor will only chase this if you ask him to. Otherwise he will just let it drag on.
There's no way of knowing who's causing this delay. You just have to ask the other party why you haven't received it
And don't proceed without it. It is very important information that you must not let the other side bully you into ignoring.0 -
Lease packs often cause problems and delays. I would suggest to anyone selling a flat that they ask their solicitor when the flat is pit on the market to request a lease pack, don't wait till you have a buyer!0

If the seller is that prepared then the easier way is not to have thrown away all the documents that he received from the MA in the first place.
That way there's no need to wait for the MA to supply additional copies (because that's all that a lease pack contains) as you can supply the originals

yes that's possible provided nothing has changed but the solicitor would still need to find out evidence of future structural spending etc.0 -

My current home that I bought last year was an executor's sale, so know it shouldn't slow the process down.
Often delays are due to the managing agents not responding to requests quite as fast as they could. A bit of prodding from your solicitor should get them sent a bit quicker, but it's never as quick as you would like it to be.
Five weeks isn't long in the scheme of things, I had a chain free sale & purchase last year & both parties anxious for things to head towards completion asap, but it still took just under 11 weeks because of waiting for the lease pack to be received & checked over by my solicitor.The bigger the bargain, the better I feel.
I should mention that there's only one of me, don't confuse me with others of the same name.0 -
i produce lease packs for a freeholder. I find it strange that i usually deal with a handful of local solicitors, often associated with EAs. They write every time and send in snail mail a request for a lease pack. I email back usually on day of receipt requesting payment by cheque or getting their client to ring direct and make debit card payment. They then post a cheque but this often takes weeks and we won't dispatch to them until recevied.
i always wonder why they don't email me for price and get client to ring straight up to make payment - would knock often over 2 weeks off waiting time.0 -

Many thanks to everyone, interesting points raised. You're certainly right ££££ redards to snail mail, think that applies to phone and post.
Apparently after chasing up ea and sol today, what has happened is that the vendor thought only one lease pack was needed for the three flats that they are selling in this block, but has now applied for the others.. Lets w-a-a-a-a-a-a-it and see0 -

Future expenditure of a non annual nature is a standard question in pre contract enquiries.Stop! Think. Read the small print. Trust nothing and assume that it is your responsibility. That way it rarely goes wrong.
