Hi first time on a forum but i really need some help please
i have yesterday received a pnc from vcs for £100 pounds this is the first letter i have got from them it says i didn't reply to there first letter but i didn't get any other letters from them. i phoned their expensive customer service line to be to be told if i wrote and told them they may reduce it to whatever the first charge would be. that's what has brought me to the internet looking for a solution. i have read quite alot and seems the best course of action is to ignore all letters is this still the case or have things changed. i would be eternally grateful if you could help me with wording any thing i may have to write as letters are not my strong point.

do not ignore, you need to appeal and get a POPLA number
This is termed a 'soft' appeal to get the number
1. The amount of the charge is disproportionate to the loss incurred by yourselves and is punitive, contravening the Unfair Contract Terms Act 1997. I also consider the PCN to be a penalty because you have alleged a breach of terms and conditions and yet have not quantified their alleged loss, as such you should now cancel the charge.
2, if you don't accept the above send me a POPLA code so i may deal with the grown ups.0 -
just to give you more information about the circumstances i was at robin hood airport for a job interview and was a little early so i stopped on a side road to have a drink and an apple as i am a diabetic and felt a little unwell as i was nervous about the interview. 2 mins later a CCTV van pulled up next to me i thought he was just recording number plates in the area for security reasons but still decided its better to move on so i went onto the airport car-park. this was in may this year i have had no letters concerning this fine until the one i received on Saturday for £100. Also the letter is in my wife's name as she is the registered keeper. i also don't recall seeing any signs, there probably is but i don't want to go back to have a read of them or i will probably get another fine.0

Just appeal and come back when you get the code, you should have recieved a letter within 14 days so add to the appeal
My first communication from you was XX days after the alleged event xx days outside the 14 days allowed under PoFA so your claim is null and void.0 -

Dear VCS,
In reference to the speculative invoice xxxxxx dated xxxxxx, the keeper denies all liability to your company as it is an unlawful punitive charge, thus a penalty! Also The first communication from you was 65 days after the alleged event 51 days outside the 14 days allowed under PoFA so your claim is null and void. If you reject this challenge the keeper requires a popla verification code for them to appeal independently,
The keeper has nothing further to add, and will not respond to any correspondence from your company unless it contains the popla code,
The challenge will be deemed accepted if there is no popla code on any rejection that you supply within the stipulated time-frame.

Just a quick piece of advice when it comes to your POPLA appeal.
Don't mention the signs are unclear or not visible. They aren't!
There are very large signs at all entrances to the site and readable
signs on just about every 2nd lamp post. Not that this makes any difference to the rest of the legalities but a lot of people use signage as an appeal point.
The signs haven't always been like this. They suddenly changed them about a year ago. Previously they were illegible from any angle in a passing car and poorly sited.

I would major on the out of time point quoting from POFA and leave it at that. You want a cancellation or POPLA code.
Using punitive point just identifies you as a forum advised person and a straight law based straight to the point puts them on the spot.0 -

Will they not just say we sent you a letter its not our fault you didn't receive it? as the first letter I have received is the second letter they send.0 -

OK that's my first appeal emailed to VCS i have recieved there generic responce email so now i wait for their rejection lol. i would like to thank everyone for there time and effort in helping me both now and in the future as my fight continues.0

Strange post, and one I would ignore, personally. Even if a PPC has changed the signs I would ALWAYS include a POPLA appeal point about the signage being unclear and not compliant with the BPA CoP. Even 'new, improved signage' is normally unclear or non-compliant. Why would anyone NOT raise a point at POPLA, the more the merrier to set up a load of banana skins for the PPC to slip on!

Let us know when you have drafted a POPLA appeal, and show it here, unhappychappie. As this is Airport land you can also cite that there is in your opinion, no keeper liability under the POF Act 2012 anyway because Airport land is likely to be covered by byelaws and is NOT 'relevant land' as defined in the POF Act 2012. You insist that the PPC must prove otherwise to POPLA (proving an absence of byelaws at this site, as confirmed by the Airport Authority themselves) if they are to rebut that point.
