Horrid Landlord, Horrid Agents

Hi,

At present we are renting. Waiting for purchase of house to complete.

We have had an antagonistic relationship with the landlord and her agents. She fell out with us a long time ago and is a money grabbing, nasty person- imo.

We are due to move out in early July. We wanted to renew the lease but with a reduced break clause due to possible job transfer of my husband. She was prepared to renew if we signed for a year, paid an extra £350 and wanted to increase the break clause from its usual 4 months to 6 months plus 60 days notice!

Anyway things are very strained. We are fed up of her and her demands.

The gardener comes on Mondays only. On tuesday the agents said someone had told them about a plant looking dead in the garden. It is a big sort of lillandye(sp). We had no intention of watering it as they requested. We pay for water, we think the tree is ill as everything else is green and lush and we don't want to help her out in any way.

Today they emailed my husband and the gardener arrived and climbed over the gate. He then proceeded to hose the tree for about 30 minutes!

WHat are our rights? We plan on turning the tap off from the inside completely. There is nothing in the lease that says we must provide water and the lease says we must not do any gardening basically.

Help please. :)

    So far as the garden is concerned: you are responsible for taking care of the landlord's property, and I am afraid that includes paying for water that the garden needs (in the same way that you have to pay for the electricity to vacuum the house before handing it back to them).

    Does it say in the lease that when the gardner comes he can use your water?
    In our contracts we state that the tenant's must look after the garden.
    I do not think that It is right that they entered and used your water supply without permission.
    The sooner you can leave there the better, no doubt from how you describe them you will probably have a fight on to get your deposit back.good luck

    If the lease states you must not do any gardening, why should the gardener use your water for the tree. Also, surely he was breaking and entering if he climbed over the gate?
    What did I do at work before I discovered MSE?!

    NOW - not sure, due to boyfriend going back to uni for masters and now pgce. Worth it in the long run!

    There is no specific mention of the use of water. We are not allowed to trim, cut or touch anything in the garden basically. Our landlord is a bit obsessed with it, and it's only a small garden. We only found out she was insane after we signed the lease about 3 years ago.

    From what I know, trespassing is not even a proper offense. I am not sure what to do. Early last year she sent us a cheque for £10 to cover the water.

    We do not want to be nasty but we are quite angry that she and her agents have mistreated us on so many occasions. We do like the house. We just do not like her or her agents.

    Yes, that is what I think too. Maybe I should ring up the police.

    Presumably if the lease states you must not do any gardening it also states you must allow access to the gardener!

    Isn't that trespass, a civil offence? I'm no legal expert but I'm pretty sure I'm right.

    I would scatter a back of weed killer liberally over the garden, before leaving a big brown *present* on their plant. Get out of that house - you don't need that kind of negativity.

    To be honest you sound a little hysterical. Ring the police over a tree? The gardener was just doing his job. You need to separate the tree issue from that of the lease.
    Been away for a while.
